| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Section 52.051(d), Government Code, is amended |
|---|
| 11 | 13 | | to read as follows: |
|---|
| 12 | 14 | | (d) The official district court reporter may not receive: |
|---|
| 13 | 15 | | (1) a salary that is more than 10 percent greater than |
|---|
| 14 | 16 | | the salary received during the preceding budget year without the |
|---|
| 15 | 17 | | approval of the commissioners court of each county in the judicial |
|---|
| 16 | 18 | | district if the court reporter serves in a county with a population |
|---|
| 17 | 19 | | of less than 1 million; [or] |
|---|
| 18 | 20 | | (2) except as provided by Subdivision (3), a |
|---|
| 19 | 21 | | percentage increase in salary in a fiscal year that is greater than |
|---|
| 20 | 22 | | the average percentage increase in compensation in that fiscal year |
|---|
| 21 | 23 | | to all other employees of the county in which the reporter serves if |
|---|
| 22 | 24 | | the court reporter serves in a county with a population of 1 million |
|---|
| 23 | 25 | | or more; or |
|---|
| 24 | 26 | | (3) a percentage increase in salary in a fiscal year |
|---|
| 25 | 27 | | that is greater than the average percentage increase in |
|---|
| 26 | 28 | | compensation in that fiscal year to all other employees of the |
|---|
| 27 | 29 | | county in which the reporter serves if the court reporter serves in |
|---|
| 28 | 30 | | a county with a population of 3.5 million or more, unless approved |
|---|
| 29 | 31 | | by the commissioners court. |

| 30 | 32 | | SECTION 2. This Act takes effect September 1, 2019. |
