66 relating to employment policies for certain health care providers

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 51.977, Education Code, is amended to
1010 read as follows:
1111 Sec. 51.977. EMPLOYMENT POLICIES FOR NURSES AND ADVANCED
1212 PRACITCE PROVIDERS IN MEDICAL AND DENTAL UNITS. (a) The president
1313 of a medical and dental unit, as defined by Section 61.003, shall
1414 determine whether a nurse, physician assistant, or pharmacist
1515 employed by the unit for patient care or clinical activities is a
1616 full-time employee for purposes of:
1717 (1) Employees group benefits under Chapter 1551 or
1818 1601, Insurance Code;
1919 (2) leave under Chapter 661 or 662, Government Code;
2020 and
2121 (3) longevity pay under Section 659.043, Government
2222 Code.
2323 (b) A determination under Subsection (a) does not entitle an
2424 individual employed in a position listed in that subsection [a
2525 nurse] who works less than 40 hours a week to the full state
2626 contribution to the cost of any coverage or benefits. However, from
2727 money other than money appropriated from the general revenue fund,
2828 the employing medical and dental unit may contribute to that cost
2929 amounts in excess of the state contribution.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2019.
