| 11 | 11 | SECTION 1. Subchapter A, Chapter 28A, Water Code, is | |
| 12 | 12 | amended by adding Section 28A.002 to read as follows: | |
| 13 | 13 | Sec. 28A.002. STREAMLINED PROGRAM FOR SMALL OPERATIONS. | |
| 14 | 14 | (a) The commission by rule shall adopt a program to offer | |
| 15 | 15 | streamlined requirements for small aggregate production | |
| 16 | 16 | operations. | |
| 17 | 17 | (b) The commission shall establish eligibility criteria for | |
| 18 | 18 | the program by rule. | |
| 19 | 19 | (c) Notwithstanding Sections 28A.051 and 28A.053, the | |
| 20 | 20 | program must: | |
| 21 | 21 | (1) allow the responsible party of a small aggregate | |
| 22 | 22 | production operation required to register under this chapter to | |
| 23 | 23 | register less frequently than annually; and | |
| 24 | 24 | (2) establish an inspection schedule for small | |
| 25 | 25 | aggregate production operations that requires inspections at least | |
| 26 | 26 | once every five years. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2019. |
