A BILL TO BE ENTITLED
AN ACT
relating to qualifications for responding to contract
solicitations from the Texas Department of Transportation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 201, Transportation Code,
is amended by adding Section 201.212 to read as follows:
Sec. 201.212. QUALIFICATIONS FOR RESPONDING TO CONTRACT
SOLICITATION. The department may not set qualifications for
responding to a request for proposals or other contract
solicitation that prohibits a person from responding to the
solicitation on the basis of having a certain minimum number of
years of experience in providing services to a local, state, or
federal entity.
SECTION 2. The change in law made by this Act applies only
to a contract for which the Texas Department of Transportation
first advertises or otherwise solicits bids, proposals, offers, or
qualifications on or after the effective date of this Act.
SECTION 3. This Act takes effect September 1, 2019.
