| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter D, Chapter 201, Transportation Code, | |
| 11 | 11 | is amended by adding Section 201.212 to read as follows: | |
| 12 | 12 | Sec. 201.212. QUALIFICATIONS FOR RESPONDING TO CONTRACT | |
| 13 | 13 | SOLICITATION. The department may not set qualifications for | |
| 14 | 14 | responding to a request for proposals or other contract | |
| 15 | 15 | solicitation that prohibits a person from responding to the | |
| 16 | 16 | solicitation on the basis of having a certain minimum number of | |
| 17 | 17 | years of experience in providing services to a local, state, or | |
| 18 | 18 | federal entity. | |
| 19 | 19 | SECTION 2. The change in law made by this Act applies only | |
| 20 | 20 | to a contract for which the Texas Department of Transportation | |
| 21 | 21 | first advertises or otherwise solicits bids, proposals, offers, or | |
| 22 | 22 | qualifications on or after the effective date of this Act. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2019. |
