7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Section 71.103(a), Business & Commerce Code, is |
---|
9 | 15 | | amended to read as follows: |
---|
10 | 16 | | (a) A [The] corporation, limited partnership, limited |
---|
11 | 17 | | liability partnership, limited liability company, or foreign |
---|
12 | 18 | | filing entity required to file a certificate under Section 71.101 |
---|
13 | 19 | | shall file the certificate in the office of the secretary of state |
---|
14 | 20 | | [and in the office or offices of each county clerk as specified by |
---|
15 | 21 | | Subsection (b) or (c)]. |
---|
16 | 22 | | SECTION 2. Sections 71.103(b) and (c) and 71.104(b), |
---|
17 | 23 | | Business & Commerce Code, are repealed. |
---|
18 | 24 | | SECTION 3. The repeal by this Act of Sections 71.103(b) and |
---|
19 | 25 | | (c) and 71.104(b), Business & Commerce Code, and the changes in law |
---|
20 | 26 | | made by this Act to Section 71.103(a), Business & Commerce Code, |
---|
21 | 27 | | apply only to an offense under Section 71.202, Business & Commerce |
---|
22 | 28 | | Code, committed on or after the effective date of this Act. An |
---|
23 | 29 | | offense committed before the effective date of this Act is governed |
---|
24 | 30 | | by the law in effect on the date the offense was committed, and that |
---|
25 | 31 | | law is continued in effect for that purpose. For purposes of this |
---|
26 | 32 | | section, an offense was committed before the effective date of this |
---|
27 | 33 | | Act if any element of the offense occurred before that date. |
---|
28 | 34 | | SECTION 4. This Act takes effect September 1, 2019. |
