| 10 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 13 | | SECTION 1. Section 552.137(c), Government Code, is amended |
|---|
| 12 | 14 | | to read as follows: |
|---|
| 13 | 15 | | (c) Subsection (a) does not apply to an e-mail address: |
|---|
| 14 | 16 | | (1) provided to a governmental body by a person who has |
|---|
| 15 | 17 | | a contractual relationship with the governmental body or by the |
|---|
| 16 | 18 | | contractor's agent; |
|---|
| 17 | 19 | | (2) provided to a governmental body by a vendor who |
|---|
| 18 | 20 | | seeks to contract with the governmental body or by the vendor's |
|---|
| 19 | 21 | | agent; |
|---|
| 20 | 22 | | (3) contained in a response to a request for bids or |
|---|
| 21 | 23 | | proposals, contained in a response to similar invitations |
|---|
| 22 | 24 | | soliciting offers or information relating to a potential contract, |
|---|
| 23 | 25 | | or provided to a governmental body in the course of negotiating the |
|---|
| 24 | 26 | | terms of a contract or potential contract; |
|---|
| 25 | 27 | | (4) provided to a governmental body on a letterhead, |
|---|
| 26 | 28 | | coversheet, printed document, or other document made available to |
|---|
| 27 | 29 | | the public; [or] |
|---|
| 28 | 30 | | (5) provided to a governmental body for the purpose of |
|---|
| 29 | 31 | | providing public comment on or receiving notices related to an |
|---|
| 30 | 32 | | application for a license as defined by Section 2001.003(2) of this |
|---|
| 31 | 33 | | code, or receiving orders or decisions from a governmental body; or |
|---|
| 32 | 34 | | (6) provided to a governmental body by an applicant |
|---|
| 33 | 35 | | for or holder of a license, as defined by Section 57.001, |
|---|
| 34 | 36 | | Occupations Code, issued by the Department of Agriculture or the |
|---|
| 35 | 37 | | Texas Department of Licensing and Regulation. |
|---|
| 36 | 38 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 37 | 39 | | to a request for information that is received by a governmental body |
|---|
| 38 | 40 | | or an officer for public information on or after the effective date |
|---|
| 39 | 41 | | of this Act. A request for information that was received before the |
|---|
| 40 | 42 | | effective date of this Act is governed by the law in effect on the |
|---|
| 41 | 43 | | date the request was received, and the former law is continued in |
|---|
| 42 | 44 | | effect for that purpose. |
|---|
| 43 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 44 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 49 | | Act takes effect September 1, 2019. |
