68 AN ACT
79 relating to the confidentiality of the e-mail address of an
810 applicant for or holder of a license issued by certain state
911 agencies.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 552.137(c), Government Code, is amended
1214 to read as follows:
1315 (c) Subsection (a) does not apply to an e-mail address:
1416 (1) provided to a governmental body by a person who has
1517 a contractual relationship with the governmental body or by the
1618 contractor's agent;
1719 (2) provided to a governmental body by a vendor who
1820 seeks to contract with the governmental body or by the vendor's
1921 agent;
2022 (3) contained in a response to a request for bids or
2123 proposals, contained in a response to similar invitations
2224 soliciting offers or information relating to a potential contract,
2325 or provided to a governmental body in the course of negotiating the
2426 terms of a contract or potential contract;
2527 (4) provided to a governmental body on a letterhead,
2628 coversheet, printed document, or other document made available to
2729 the public; [or]
2830 (5) provided to a governmental body for the purpose of
2931 providing public comment on or receiving notices related to an
3032 application for a license as defined by Section 2001.003(2) of this
3133 code, or receiving orders or decisions from a governmental body; or
3234 (6) provided to a governmental body by an applicant
3335 for or holder of a license, as defined by Section 57.001,
3436 Occupations Code, issued by the Department of Agriculture or the
3537 Texas Department of Licensing and Regulation.
3638 SECTION 2. The change in law made by this Act applies only
3739 to a request for information that is received by a governmental body
3840 or an officer for public information on or after the effective date
3941 of this Act. A request for information that was received before the
4042 effective date of this Act is governed by the law in effect on the
4143 date the request was received, and the former law is continued in
4244 effect for that purpose.
4345 SECTION 3. This Act takes effect immediately if it receives
4446 a vote of two-thirds of all the members elected to each house, as
4547 provided by Section 39, Article III, Texas Constitution. If this
4648 Act does not receive the vote necessary for immediate effect, this
4749 Act takes effect September 1, 2019.
