55 AN ACT
66 relating to the registration and regulation of brokers by the
77 Public Utility Commission of Texas.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter H, Chapter 39, Utilities Code, is
1010 amended by adding Section 39.3555 to read as follows:
1111 Sec. 39.3555. REGISTRATION OF BROKERS. (a) In this
1212 section, "brokerage services" means providing advice or
1313 procurement services to, or acting on behalf of, a retail electric
1414 customer regarding the selection of a retail electric provider, or
1515 the product or service of a retail electric provider, or selling or
1616 attempting to sell retail electric products or services offered by
1717 retail electric providers to retail electric customers, including
1818 online services.
1919 (b) A person may not provide brokerage services in this
2020 state for compensation or other consideration unless the person is
2121 registered with the commission as a broker.
2222 (c) A retail electric provider is not a broker and may not
2323 knowingly provide bids or offers to an unregistered broker, and a
2424 broker may not sell or take title to electric energy.
2525 (d) A person who registers under this section shall comply
2626 with customer protection provisions, disclosure requirements, and
2727 marketing guidelines established by the commission and by this
2828 title.
2929 (e) The commission shall adopt rules as necessary to
3030 implement this section.
3131 (f) The commission shall process a person's application for
3232 registration as a broker not later than the 60th day after the date
3333 the person files the application.
3434 SECTION 2. This Act takes effect September 1, 2019.
