| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter H, Chapter 39, Utilities Code, is |
|---|
| 10 | 10 | | amended by adding Section 39.3555 to read as follows: |
|---|
| 11 | 11 | | Sec. 39.3555. REGISTRATION OF BROKERS. (a) In this |
|---|
| 12 | 12 | | section, "brokerage services" means providing advice or |
|---|
| 13 | 13 | | procurement services to, or acting on behalf of, a retail electric |
|---|
| 14 | 14 | | customer regarding the selection of a retail electric provider, or |
|---|
| 15 | 15 | | the product or service of a retail electric provider, or selling or |
|---|
| 16 | 16 | | attempting to sell retail electric products or services offered by |
|---|
| 17 | 17 | | retail electric providers to retail electric customers, including |
|---|
| 18 | 18 | | online services. |
|---|
| 19 | 19 | | (b) A person may not provide brokerage services in this |
|---|
| 20 | 20 | | state for compensation or other consideration unless the person is |
|---|
| 21 | 21 | | registered with the commission as a broker. |
|---|
| 22 | 22 | | (c) A retail electric provider is not a broker and may not |
|---|
| 23 | 23 | | knowingly provide bids or offers to an unregistered broker, and a |
|---|
| 24 | 24 | | broker may not sell or take title to electric energy. |
|---|
| 25 | 25 | | (d) A person who registers under this section shall comply |
|---|
| 26 | 26 | | with customer protection provisions, disclosure requirements, and |
|---|
| 27 | 27 | | marketing guidelines established by the commission and by this |
|---|
| 28 | 28 | | title. |
|---|
| 29 | 29 | | (e) The commission shall adopt rules as necessary to |
|---|
| 30 | 30 | | implement this section. |
|---|
| 31 | 31 | | (f) The commission shall process a person's application for |
|---|
| 32 | 32 | | registration as a broker not later than the 60th day after the date |
|---|
| 33 | 33 | | the person files the application. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2019. |
