| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 51.9362 to read as follows: |
|---|
| 14 | 14 | | Sec. 51.9362. DRUG AND ALCOHOL AWARENESS TRAINING FOR |
|---|
| 15 | 15 | | RESIDENTIAL ADVISORS AND STUDENT ORGANIZATION OFFICERS. (a) In |
|---|
| 16 | 16 | | this section: |
|---|
| 17 | 17 | | (1) "Public or private institution of higher |
|---|
| 18 | 18 | | education" includes an "institution of higher education" and a |
|---|
| 19 | 19 | | "private or independent institution of higher education," as those |
|---|
| 20 | 20 | | terms are defined by Section 61.003. |
|---|
| 21 | 21 | | (2) "Residential advisor" means a student who is |
|---|
| 22 | 22 | | employed by a public or private institution of higher education to |
|---|
| 23 | 23 | | serve in an advisory capacity for students living in a residential |
|---|
| 24 | 24 | | facility. |
|---|
| 25 | 25 | | (3) "Residential facility" means a residence used |
|---|
| 26 | 26 | | exclusively for housing or boarding students or faculty of a public |
|---|
| 27 | 27 | | or private institution of higher education. |
|---|
| 28 | 28 | | (4) "Student organization" includes any organization |
|---|
| 29 | 29 | | that is composed mostly of students enrolled at a public or private |
|---|
| 30 | 30 | | institution of higher education and that: |
|---|
| 31 | 31 | | (A) is registered with the institution; |
|---|
| 32 | 32 | | (B) receives student organization resource fee |
|---|
| 33 | 33 | | revenues or other funding from the institution; or |
|---|
| 34 | 34 | | (C) is otherwise recognized as a student |
|---|
| 35 | 35 | | organization by the institution. |
|---|
| 36 | 36 | | (b) A public or private institution of higher education that |
|---|
| 37 | 37 | | imposes any mandatory training requirements on residential |
|---|
| 38 | 38 | | advisors or officers of student organizations must ensure that drug |
|---|
| 39 | 39 | | and alcohol overdose awareness and appropriate response training is |
|---|
| 40 | 40 | | included with that training. |
|---|
| 41 | 41 | | SECTION 2. This Act applies beginning with training |
|---|
| 42 | 42 | | required for the 2019-2020 academic year. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2019. |
