66 AN ACT
77 relating to drug or alcohol overdose awareness and response
88 training for residential advisors and officers of student
99 organizations at public or private institutions of higher
1010 education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1313 amended by adding Section 51.9362 to read as follows:
1414 Sec. 51.9362. DRUG AND ALCOHOL AWARENESS TRAINING FOR
1515 RESIDENTIAL ADVISORS AND STUDENT ORGANIZATION OFFICERS. (a) In
1616 this section:
1717 (1) "Public or private institution of higher
1818 education" includes an "institution of higher education" and a
1919 "private or independent institution of higher education," as those
2020 terms are defined by Section 61.003.
2121 (2) "Residential advisor" means a student who is
2222 employed by a public or private institution of higher education to
2323 serve in an advisory capacity for students living in a residential
2424 facility.
2525 (3) "Residential facility" means a residence used
2626 exclusively for housing or boarding students or faculty of a public
2727 or private institution of higher education.
2828 (4) "Student organization" includes any organization
2929 that is composed mostly of students enrolled at a public or private
3030 institution of higher education and that:
3131 (A) is registered with the institution;
3232 (B) receives student organization resource fee
3333 revenues or other funding from the institution; or
3434 (C) is otherwise recognized as a student
3535 organization by the institution.
3636 (b) A public or private institution of higher education that
3737 imposes any mandatory training requirements on residential
3838 advisors or officers of student organizations must ensure that drug
3939 and alcohol overdose awareness and appropriate response training is
4040 included with that training.
4141 SECTION 2. This Act applies beginning with training
4242 required for the 2019-2020 academic year.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2019.
