55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to healthy relationships education in public schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1010 amended by adding Section 28.0043 to read as follows:
1111 Sec. 28.0043. HEALTHY RELATIONSHIPS EDUCATION. (a) In
1212 this section, "age-appropriate" means suitable to particular ages
1313 or age groups of children or adolescents, based on developing
1414 cognitive, emotional, and behavioral capacity typical for the age
1515 or age group.
1616 (b) A school district shall provide healthy relationships
1717 education in accordance with this section at grade levels and in
1818 courses specified by the State Board of Education.
1919 (c) The State Board of Education by rule shall adopt the
2020 essential knowledge and skills for curricula to be used by a school
2121 district in providing healthy relationships education under this
2222 section that are age-appropriate and supported by research that is
2323 peer-reviewed, conducted in compliance with accepted scientific
2424 methods, and recognized as accurate by leading professional
2525 organizations and agencies with relevant experience. As
2626 age-appropriate, the curricula must promote relationship,
2727 communication, and decision-making skills, including strategies
2828 to:
2929 (1) develop healthy, age-appropriate relationships;
3030 (2) develop healthy life skills, including critical
3131 thinking, problem solving, effective communication, and
3232 responsible decision making about relationships; and
3333 (3) promote effective communication between
3434 adolescents and their parents, legal guardians, or other family
3535 members about relationships.
3636 SECTION 2. Section 12.104(b), Education Code, as amended by
3737 Chapters 324 (S.B. 1488), 522 (S.B. 179), and 735 (S.B. 1153), Acts
3838 of the 85th Legislature, Regular Session, 2017, is reenacted and
3939 amended to read as follows:
4040 (b) An open-enrollment charter school is subject to:
4141 (1) a provision of this title establishing a criminal
4242 offense; and
4343 (2) a prohibition, restriction, or requirement, as
4444 applicable, imposed by this title or a rule adopted under this
4545 title, relating to:
4646 (A) the Public Education Information Management
4747 System (PEIMS) to the extent necessary to monitor compliance with
4848 this subchapter as determined by the commissioner;
4949 (B) criminal history records under Subchapter C,
5050 Chapter 22;
5151 (C) reading instruments and accelerated reading
5252 instruction programs under Section 28.006;
5353 (D) accelerated instruction under Section
5454 28.0211;
5555 (E) high school graduation requirements under
5656 Section 28.025;
5757 (F) special education programs under Subchapter
5858 A, Chapter 29;
5959 (G) bilingual education under Subchapter B,
6060 Chapter 29;
6161 (H) prekindergarten programs under Subchapter E
6262 or E-1, Chapter 29;
6363 (I) extracurricular activities under Section
6464 33.081;
6565 (J) discipline management practices or behavior
6666 management techniques under Section 37.0021;
6767 (K) health and safety under Chapter 38;
6868 (L) public school accountability under
6969 Subchapters B, C, D, F, G, and J, Chapter 39, and Chapter 39A;
7070 (M) the requirement under Section 21.006 to
7171 report an educator's misconduct;
7272 (N) intensive programs of instruction under
7373 Section 28.0213;
7474 (O) the right of a school employee to report a
7575 crime, as provided by Section 37.148; [and]
7676 (P) bullying prevention policies and procedures
7777 under Section 37.0832;
7878 (Q) the right of a school under Section 37.0052
7979 to place a student who has engaged in certain bullying behavior in a
8080 disciplinary alternative education program or to expel the student;
8181 [and]
8282 (R) the right under Section 37.0151 to report to
8383 local law enforcement certain conduct constituting assault or
8484 harassment;
8585 (S) [(P)] a parent's right to information
8686 regarding the provision of assistance for learning difficulties to
8787 the parent's child as provided by Sections 26.004(b)(11) and
8888 26.0081(c) and (d); and
8989 (T) healthy relationships education under
9090 Section 28.0043.
9191 SECTION 3. This Act applies beginning with the 2020-2021
9292 school year.
9393 SECTION 4. To the extent of any conflict, this Act prevails
9494 over another Act of the 86th Legislature, Regular Session, 2019,
9595 relating to nonsubstantive additions to and corrections in enacted
9696 codes.
9797 SECTION 5. This Act takes effect immediately if it receives
9898 a vote of two-thirds of all the members elected to each house, as
9999 provided by Section 39, Article III, Texas Constitution. If this
100100 Act does not receive the vote necessary for immediate effect, this
101101 Act takes effect September 1, 2019.
