4	10		AN ACT
5	11		relating to the powers and duties of the North Central Texas
6	12		Municipal Water Authority.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 9, Chapter 86, Acts of the 55th
9	15		Legislature, Regular Session, 1957, is amended to read as follows:
10	16		Sec. 9. The Authority is empowered to acquire land and to
11	17		construct, lease or otherwise acquire all works, plants and other
12	18		facilities necessary or useful for the purpose of diverting,
13	19		further impounding or storing water, processing such water and
14	20		transporting it to cities and others for municipal, domestic,
15	21		industrial and mining purposes. Subject to the terms of any deed of
16	22		trust issued by the Authority, the Authority may sell, trade or
17	23		otherwise dispose of any real or personal property deemed by the
18	24		Board of Directors not to be needed for Authority purposes. The
19	25		Authority is [not] authorized to develop or otherwise acquire
20	26		underground sources of water. The Authority is not authorized to
21	27		exercise powers of eminent domain outside the boundaries of Baylor,
22	28		Knox, Haskell and Throckmorton Counties.
23	29		SECTION 2. All acts of the North Central Texas Municipal
24	30		Water Authority relating to the development or acquisition of
25	31		groundwater occurring on or before the effective date of this Act
26	32		and taken in response to emergency drought conditions that have not
27	33		been rescinded or are the subject of pending litigation are
28	34		validated in all respects.
29	35		SECTION 3. This Act takes effect September 1, 2019.
