412 AN ACT
513 relating to grants for disaster response by nonprofit food banks.
614 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
715 SECTION 1. Subchapter B, Chapter 418, Government Code, is
816 amended by adding Section 418.026 to read as follows:
917 Sec. 418.026. GRANTS FOR DISASTER RESPONSE BY NONPROFIT
1018 FOOD BANKS. (a) In this section, "nonprofit food bank" means a
1119 nonprofit organization that solicits, warehouses, and
1220 redistributes edible food to agencies that feed needy families and
1321 individuals.
1422 (b) Using money available for the purpose, the office of the
1523 governor shall establish a program to provide grants to nonprofit
1624 organizations in this state for distribution to nonprofit food
1725 banks to build the capacity of the nonprofit food banks to respond
1826 to disasters.
1927 (c) To be eligible to receive a grant under this section, a
2028 nonprofit organization must:
2129 (1) have at least five years of experience
2230 coordinating a statewide network of nonprofit food banks and
2331 charitable organizations that distribute food to needy or low
2432 income individuals during disasters; and
2533 (2) be a member of the Texas Voluntary Organizations
2634 Active in Disaster.
2735 (d) Grant money awarded under this section may be used only
2836 to reimburse a nonprofit food bank for all or part of the costs
2937 incurred by the nonprofit food bank as a result of:
3038 (1) maintaining an inventory of emergency food boxes
3139 in preparation for a disaster;
3240 (2) purchasing, storing, and transporting food for
3341 distribution during a disaster; and
3442 (3) purchasing capital equipment necessary to operate
3543 during a disaster, including back-up generators, mobile food
3644 pantries, trucks, meal preparation units, forklifts, technology,
3745 and other equipment.
3846 (e) The office of the governor shall establish procedures to
3947 administer the grant program, including a procedure for the
4048 submission of a proposal and a procedure to be used by the office to
4149 evaluate a proposal.
4250 (f) The office of the governor shall enter into a contract
4351 that includes performance requirements with each grant recipient.
4452 The office shall monitor and enforce the terms of the contract. The
4553 contract must authorize the office to recoup grant money from a
4654 grant recipient for failure of the grant recipient to comply with
4755 the terms of the contract.
4856 (g) The office of the governor may solicit and accept gifts,
4957 grants, and donations from any source for the purpose of awarding
5058 grants under this section.
5159 SECTION 2. The office of the governor is required to
5260 implement a provision of this Act only if the legislature
5361 appropriates money specifically for that purpose. If the
5462 legislature does not appropriate money specifically for that
5563 purpose, the office may, but is not required to, implement a
5664 provision of this Act using other appropriations available for that
5765 purpose.
5866 SECTION 3. This Act takes effect September 1, 2019.
