6 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 15 | | SECTION 1. Subchapter B, Chapter 418, Government Code, is |
---|
8 | 16 | | amended by adding Section 418.026 to read as follows: |
---|
9 | 17 | | Sec. 418.026. GRANTS FOR DISASTER RESPONSE BY NONPROFIT |
---|
10 | 18 | | FOOD BANKS. (a) In this section, "nonprofit food bank" means a |
---|
11 | 19 | | nonprofit organization that solicits, warehouses, and |
---|
12 | 20 | | redistributes edible food to agencies that feed needy families and |
---|
13 | 21 | | individuals. |
---|
14 | 22 | | (b) Using money available for the purpose, the office of the |
---|
15 | 23 | | governor shall establish a program to provide grants to nonprofit |
---|
16 | 24 | | organizations in this state for distribution to nonprofit food |
---|
17 | 25 | | banks to build the capacity of the nonprofit food banks to respond |
---|
18 | 26 | | to disasters. |
---|
19 | 27 | | (c) To be eligible to receive a grant under this section, a |
---|
20 | 28 | | nonprofit organization must: |
---|
21 | 29 | | (1) have at least five years of experience |
---|
22 | 30 | | coordinating a statewide network of nonprofit food banks and |
---|
23 | 31 | | charitable organizations that distribute food to needy or low |
---|
24 | 32 | | income individuals during disasters; and |
---|
25 | 33 | | (2) be a member of the Texas Voluntary Organizations |
---|
26 | 34 | | Active in Disaster. |
---|
27 | 35 | | (d) Grant money awarded under this section may be used only |
---|
28 | 36 | | to reimburse a nonprofit food bank for all or part of the costs |
---|
29 | 37 | | incurred by the nonprofit food bank as a result of: |
---|
30 | 38 | | (1) maintaining an inventory of emergency food boxes |
---|
31 | 39 | | in preparation for a disaster; |
---|
32 | 40 | | (2) purchasing, storing, and transporting food for |
---|
33 | 41 | | distribution during a disaster; and |
---|
34 | 42 | | (3) purchasing capital equipment necessary to operate |
---|
35 | 43 | | during a disaster, including back-up generators, mobile food |
---|
36 | 44 | | pantries, trucks, meal preparation units, forklifts, technology, |
---|
37 | 45 | | and other equipment. |
---|
38 | 46 | | (e) The office of the governor shall establish procedures to |
---|
39 | 47 | | administer the grant program, including a procedure for the |
---|
40 | 48 | | submission of a proposal and a procedure to be used by the office to |
---|
41 | 49 | | evaluate a proposal. |
---|
42 | 50 | | (f) The office of the governor shall enter into a contract |
---|
43 | 51 | | that includes performance requirements with each grant recipient. |
---|
44 | 52 | | The office shall monitor and enforce the terms of the contract. The |
---|
45 | 53 | | contract must authorize the office to recoup grant money from a |
---|
46 | 54 | | grant recipient for failure of the grant recipient to comply with |
---|
47 | 55 | | the terms of the contract. |
---|
48 | 56 | | (g) The office of the governor may solicit and accept gifts, |
---|
49 | 57 | | grants, and donations from any source for the purpose of awarding |
---|
50 | 58 | | grants under this section. |
---|
51 | 59 | | SECTION 2. The office of the governor is required to |
---|
52 | 60 | | implement a provision of this Act only if the legislature |
---|
53 | 61 | | appropriates money specifically for that purpose. If the |
---|
54 | 62 | | legislature does not appropriate money specifically for that |
---|
55 | 63 | | purpose, the office may, but is not required to, implement a |
---|
56 | 64 | | provision of this Act using other appropriations available for that |
---|
57 | 65 | | purpose. |
---|
58 | 66 | | SECTION 3. This Act takes effect September 1, 2019. |
