| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Subchapter A, Chapter 464, Health and Safety |
|---|
| 11 | 13 | | Code, is amended by adding Section 464.021 to read as follows: |

| 12 | 14 | | Sec. 464.021. SUBSTANCE USE DISORDER DATA COLLECTION. (a) |
|---|
| 13 | 15 | | In this section, "commission" means the Health and Human Services |
|---|
| 14 | 16 | | Commission. |
|---|
| 15 | 17 | | (b) The commission, in cooperation with the department, |
|---|
| 16 | 18 | | shall collect relevant admission, discharge, and transfer data |
|---|
| 17 | 19 | | relating to treatment facilities licensed under this chapter in a |
|---|
| 18 | 20 | | manner necessary to: |
|---|
| 19 | 21 | | (1) satisfy applicable data set requirements |
|---|
| 20 | 22 | | published by the Substance Abuse and Mental Health Services |
|---|
| 21 | 23 | | Administration of the United States Department of Health and Human |
|---|
| 22 | 24 | | Services; and |
|---|
| 23 | 25 | | (2) maximize the overall state allotment of federal |
|---|
| 24 | 26 | | funds. |
|---|
| 25 | 27 | | (c) The commission shall collect and report data described |
|---|
| 26 | 28 | | by Subsection (b) in a manner that complies with state and federal |
|---|
| 27 | 29 | | laws regarding confidentiality. The data collected is not public |
|---|
| 28 | 30 | | information under Chapter 552, Government Code. |
|---|
| 29 | 31 | | SECTION 2. This Act takes effect September 1, 2019. |
