8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 36.003, Health and Safety Code, is | |
10 | 10 | amended by adding Subsection (10) to read as follows: | |
11 | 11 | (10) "Electronic eye chart" means any system, device, | |
12 | 12 | or method, computerized or otherwise, that displays medically | |
13 | 13 | accepted and properly sized optotypes (letters, numbers or symbols) | |
14 | 14 | on an electronic screen that individuals identify to assess visual | |
15 | 15 | acuity. | |
16 | 16 | SECTION 2. Section 36.004, Health and Safety Code, is | |
17 | 17 | amended by adding Subsection (b-2) to read as follows: | |
18 | 18 | (b-2) The rules must allow an individual who attends a | |
19 | 19 | public or private school to be screened using an electronic eye | |
20 | 20 | chart to detect vision disorders as an accepted equivalent to a | |
21 | 21 | printed eye chart. | |
22 | 22 | SECTION 3. As soon as practicable after the effective date | |
23 | 23 | of this Act, the executive commissioner of the Health and Human | |
24 | 24 | Services Commission shall adopt the rules necessary to implement | |
25 | 25 | the changes in law made by this Act. | |
26 | 26 | SECTION 4. This Act takes effect September 1, 2019. |
