55 AN ACT
66 relating to requirements for screenings in public or private
77 schools to detect vision disorders of students.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 36.003, Health and Safety Code, is
1010 amended by adding Subsection (10) to read as follows:
1111 (10) "Electronic eye chart" means any system, device,
1212 or method, computerized or otherwise, that displays medically
1313 accepted and properly sized optotypes (letters, numbers or symbols)
1414 on an electronic screen that individuals identify to assess visual
1515 acuity.
1616 SECTION 2. Section 36.004, Health and Safety Code, is
1717 amended by adding Subsection (b-2) to read as follows:
1818 (b-2) The rules must allow an individual who attends a
1919 public or private school to be screened using an electronic eye
2020 chart to detect vision disorders as an accepted equivalent to a
2121 printed eye chart.
2222 SECTION 3. As soon as practicable after the effective date
2323 of this Act, the executive commissioner of the Health and Human
2424 Services Commission shall adopt the rules necessary to implement
2525 the changes in law made by this Act.
2626 SECTION 4. This Act takes effect September 1, 2019.
