55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authorization and reporting of expenditures for
88 lobbying activities by certain political subdivisions and other
99 public entities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 140, Local Government Code, is amended
1212 by adding Section 140.012 to read as follows:
1313 Sec. 140.012. EXPENDITURES FOR LOBBYING ACTIVITIES. (a)
1414 This section applies only to a:
1515 (1) political subdivision that imposes a tax;
1616 (2) political subdivision or special district that has
1717 the authority to issue bonds, including revenue bonds;
1818 (3) regional mobility authority;
1919 (4) transit authority;
2020 (5) regional tollway authority;
2121 (6) special purpose district;
2222 (7) public institution of higher education;
2323 (8) community college district;
2424 (9) publicly owned utility; and
2525 (10) river authority.
2626 (b) A political subdivision or entity described by
2727 Subsection (a) may spend money to directly or indirectly influence
2828 or attempt to influence the outcome of any legislation pending
2929 before the legislature only if the expenditure is authorized by a
3030 majority vote of the governing body of the political subdivision or
3131 entity in an open meeting of the governing body. The expenditure
3232 must be voted on by the governing body as a stand-alone item on the
3333 agenda at the meeting.
3434 (c) A political subdivision or entity described by
3535 Subsection (a) shall report to the Texas Ethics Commission and
3636 publish on the political subdivision's or entity's Internet
3737 website:
3838 (1) the amount of money authorized under Subsection
3939 (b) for the purpose of directly or indirectly influencing or
4040 attempting to influence the outcome of any legislation pending
4141 before the legislature;
4242 (2) the name of any person required to register under
4343 Chapter 305, Government Code, retained or employed by the political
4444 subdivision or entity for the purpose described by Subdivision (1);
4545 and
4646 (3) an electronic copy of any contract for services
4747 for the purpose described by Subdivision (1) that is entered into by
4848 the political subdivision or entity with each person listed under
4949 Subdivision (2).
5050 (d) In addition to the requirements of Subsection (c), a
5151 political subdivision or entity described by Subsection (a) shall
5252 report to the Texas Ethics Commission and publish on the political
5353 subdivision's or entity's Internet website the amount of public
5454 money spent for membership fees and dues of any nonprofit state
5555 association or organization of similarly situated political
5656 subdivisions or entities that directly or indirectly influences or
5757 attempts to influence the outcome of any legislation pending before
5858 the legislature.
5959 (e) The Texas Ethics Commission shall make available to the
6060 public a searchable database on the commission's Internet website
6161 containing the reports submitted to the commission under Subsection
6262 (c).
6363 (f) If a political subdivision or entity described by
6464 Subsection (a) does not comply with the requirements of this
6565 section, an interested party is entitled to appropriate injunctive
6666 relief to prevent further activity in violation of this section.
6767 For purposes of this subsection, "interested party" means a person
6868 who:
6969 (1) is a taxpayer of the political subdivision or
7070 entity described by Subsection (a); or
7171 (2) is served by or receives services from the
7272 political subdivision or entity described by Subsection (a).
7373 SECTION 2. This Act takes effect September 1, 2019.
