| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 11, Election Code, is amended by adding |
|---|
| 11 | 11 | | Section 11.0021 to read as follows: |
|---|
| 12 | 12 | | Sec. 11.0021. MEASURES TO PREVENT NONCITIZEN VOTER |
|---|
| 13 | 13 | | REGISTRATION AND VOTING. Notwithstanding any other law, to ensure |
|---|
| 14 | 14 | | a person who is not a citizen of the United States may not register |
|---|
| 15 | 15 | | to vote or vote: |
|---|
| 16 | 16 | | (1) at least twice each year, the secretary of state |
|---|
| 17 | 17 | | shall use the United States Department of Homeland Security |
|---|
| 18 | 18 | | database of noncitizens living in Texas to identify noncitizens |
|---|
| 19 | 19 | | whose voter registrations should be canceled and shall take all |
|---|
| 20 | 20 | | appropriate actions; |
|---|
| 21 | 21 | | (2) the Department of Public Safety shall forward to |
|---|
| 22 | 22 | | the secretary of state the file of a person who applies for a Texas |
|---|
| 23 | 23 | | driver's license or identification card and provides on the |
|---|
| 24 | 24 | | application form that the person is not a citizen of the United |
|---|
| 25 | 25 | | States; |
|---|
| 26 | 26 | | (3) the secretary of state may audit a county's voter |
|---|
| 27 | 27 | | registration list to ensure a county complies with: |
|---|
| 28 | 28 | | (A) state law; and |
|---|
| 29 | 29 | | (B) the secretary of state's directives, |
|---|
| 30 | 30 | | including a requested deletion from a county's voter registration |
|---|
| 31 | 31 | | list; and |
|---|
| 32 | 32 | | (4) a county registrar shall take all appropriate |
|---|
| 33 | 33 | | actions to confirm the citizenship status of a person who applies |
|---|
| 34 | 34 | | for voter registration whose application does not provide: |
|---|
| 35 | 35 | | (A) the person's Texas driver's license number or |
|---|
| 36 | 36 | | the number of an identification card issued by the Department of |
|---|
| 37 | 37 | | Public Safety to the person; or |
|---|
| 38 | 38 | | (B) the last four digits of the person's social |
|---|
| 39 | 39 | | security number. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2019. |
