76 AN ACT
87 relating to indicators of achievement under the public school
98 accountability system.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 39.053(c), Education Code, as amended by
1211 Chapters 807 (H.B. 22), 842 (H.B. 2223), and 1088 (H.B. 3593), Acts
1312 of the 85th Legislature, Regular Session, 2017, is reenacted and
1413 amended to read as follows:
1514 (c) School districts and campuses must be evaluated based on
1615 three domains of indicators of achievement adopted under this
1716 section that include:
1817 (1) in the student achievement domain, indicators of
1918 student achievement that must include:
2019 (A) for evaluating the performance of districts
2120 and campuses generally:
2221 (i) an indicator that accounts for the
2322 results of assessment instruments required under Sections
2423 39.023(a), (c), and (l), as applicable for the district and campus,
2524 including the results of assessment instruments required for
2625 graduation retaken by a student, aggregated across grade levels by
2726 subject area, including:
2827 (a) for the performance standard
2928 determined by the commissioner under Section 39.0241(a), the
3029 percentage of students who performed satisfactorily on the
3130 assessment instruments, aggregated across grade levels by subject
3231 area; and
3332 (b) for the college readiness
3433 performance standard as determined under Section 39.0241, the
3534 percentage of students who performed satisfactorily on the
3635 assessment instruments, aggregated across grade levels by subject
3736 area; and
3837 (ii) an indicator that accounts for the
3938 results of assessment instruments required under Section
4039 39.023(b), as applicable for the district and campus, including the
4140 percentage of students who performed satisfactorily on the
4241 assessment instruments, as determined by the performance standard
4342 adopted by the agency, aggregated across grade levels by subject
4443 area; and
4544 (B) for evaluating the performance of high school
4645 campuses and districts that include high school campuses,
4746 indicators that account for:
4847 (i) students who satisfy the Texas Success
4948 Initiative (TSI) college readiness benchmarks prescribed by the
5049 Texas Higher Education Coordinating Board under Section 51.334 on
5150 an assessment instrument in reading or mathematics designated by
5251 the coordinating board under that section;
5352 (ii) students who satisfy relevant
5453 performance standards on advanced placement tests or similar
5554 assessments;
5655 (iii) students who earn dual course credits
5756 in the dual credit courses;
5857 (iv) students who enlist in the armed
5958 forces of the United States;
6059 (v) students who earn industry
6160 certifications;
6261 (vi) students admitted into postsecondary
6362 industry certification programs that require as a prerequisite for
6463 entrance successful performance at the secondary level;
6564 (vii) students whose successful completion
6665 of a course or courses under Section 28.014 indicates the student's
6766 preparation to enroll and succeed, without remediation, in an
6867 entry-level general education course for a baccalaureate degree or
6968 associate degree;
7069 (viii) students who successfully met
7170 standards on a composite of indicators that through research
7271 indicates the student's preparation to enroll and succeed, without
7372 remediation, in an entry-level general education course for a
7473 baccalaureate degree or associate degree;
7574 (ix) high school graduation rates, computed
7675 in accordance with standards and definitions adopted in compliance
7776 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
7877 subject to the exclusions provided by Subsections (g), (g-1),
7978 (g-2), and (g-3);
8079 (x) students who successfully completed an
8180 OnRamps dual enrollment course; [and]
8281 (xi) [the percentage of] students who
8382 successfully completed a practicum or internship approved by the
8483 State Board of Education;
8584 (xii) students who are awarded an associate
8685 [associate's] degree; and
8786 (xiii) students who successfully complete a
8887 coherent sequence of career and technology courses or a combination
8988 of career and technology courses, capstone courses, or practicums
9089 as part of a four-year plan of study;
9190 (2) in the school progress domain, indicators for
9291 effectiveness in promoting student learning, which must include:
9392 (A) for assessment instruments, including
9493 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
9594 percentage of students who met the standard for improvement, as
9695 determined by the commissioner; and
9796 (B) for evaluating relative performance, the
9897 performance of districts and campuses compared to similar districts
9998 or campuses; and
10099 (3) in the closing the gaps domain, the use of
101100 disaggregated data to demonstrate the differentials among students
102101 from different racial and ethnic groups, socioeconomic
103102 backgrounds, and other factors, including:
104103 (A) students formerly receiving special
105104 education services;
106105 (B) students continuously enrolled; and
107106 (C) students who are mobile.
108107 SECTION 2. To the extent of any conflict, this Act prevails
109108 over another Act of the 86th Legislature, Regular Session, 2019,
110109 relating to nonsubstantive additions to and corrections in enacted
111110 codes.
112111 SECTION 3. This Act applies beginning with the 2019-2020
113112 school year.
114113 SECTION 4. This Act takes effect immediately if it receives
115114 a vote of two-thirds of all the members elected to each house, as
116115 provided by Section 39, Article III, Texas Constitution. If this
117116 Act does not receive the vote necessary for immediate effect, this
118117 Act takes effect September 1, 2019.
