55 AN ACT
66 relating to value-based arrangements for prescription drugs in
77 Medicaid.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 531, Government Code, is amended by
1010 adding Section 531.0701 to read as follows:
1111 Sec. 531.0701. VALUE-BASED ARRANGEMENTS. Subject to
1212 531.071, the commission may enter into a written agreement with a
1313 manufacturer of prescription drugs as defined by 42 U.S.C. Section
1414 1396r-8(k)(5) and its subsequent amendments, including a
1515 subsidiary or affiliate of a manufacturer, based on outcomes data,
1616 or other metrics agreed to in writing by the state and a
1717 pharmaceutical manufacturer. Such agreements may include but not
1818 be limited to rebates, discounts, price reductions, contributions,
1919 risk sharing, reimbursements, deferral of payments (e.g.
2020 installment payments), guarantees, patient care, shared savings
2121 payments, withholds, or bonuses or anything of value.
2222 SECTION 2. The Health and Human Services Commission shall
2323 amend contracts with managed care plans to ensure those contracts
2424 comply with Section 531.0701, Government Code, as added by this
2525 Act.
2626 SECTION 3. This Act takes effect September 1, 2019.
