| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 531, Government Code, is amended by |
|---|
| 10 | 10 | | adding Section 531.0701 to read as follows: |
|---|
| 11 | 11 | | Sec. 531.0701. VALUE-BASED ARRANGEMENTS. Subject to |
|---|
| 12 | 12 | | 531.071, the commission may enter into a written agreement with a |
|---|
| 13 | 13 | | manufacturer of prescription drugs as defined by 42 U.S.C. Section |
|---|
| 14 | 14 | | 1396r-8(k)(5) and its subsequent amendments, including a |
|---|
| 15 | 15 | | subsidiary or affiliate of a manufacturer, based on outcomes data, |
|---|
| 16 | 16 | | or other metrics agreed to in writing by the state and a |
|---|
| 17 | 17 | | pharmaceutical manufacturer. Such agreements may include but not |
|---|
| 18 | 18 | | be limited to rebates, discounts, price reductions, contributions, |
|---|
| 19 | 19 | | risk sharing, reimbursements, deferral of payments (e.g. |
|---|
| 20 | 20 | | installment payments), guarantees, patient care, shared savings |
|---|
| 21 | 21 | | payments, withholds, or bonuses or anything of value. |

| 22 | 22 | | SECTION 2. The Health and Human Services Commission shall |
|---|
| 23 | 23 | | amend contracts with managed care plans to ensure those contracts |
|---|
| 24 | 24 | | comply with Section 531.0701, Government Code, as added by this |
|---|
| 25 | 25 | | Act. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2019. |
