76 AN ACT
87 relating to a trauma-informed care policy for school districts and
98 open-enrollment charter schools and training regarding the policy
109 for district and school employees.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Section 11.252(a), Education Code, is amended to
1312 read as follows:
1413 (a) Each school district shall have a district improvement
1514 plan that is developed, evaluated, and revised annually, in
1615 accordance with district policy, by the superintendent with the
1716 assistance of the district-level committee established under
1817 Section 11.251. The purpose of the district improvement plan is to
1918 guide district and campus staff in the improvement of student
2019 performance for all student groups in order to attain state
2120 standards in respect to the achievement indicators adopted under
2221 Section 39.053(c). The district improvement plan must include
2322 provisions for:
2423 (1) a comprehensive needs assessment addressing
2524 district student performance on the achievement indicators, and
2625 other appropriate measures of performance, that are disaggregated
2726 by all student groups served by the district, including categories
2827 of ethnicity, socioeconomic status, sex, and populations served by
2928 special programs, including students in special education programs
3029 under Subchapter A, Chapter 29;
3130 (2) measurable district performance objectives for
3231 all appropriate achievement indicators for all student
3332 populations, including students in special education programs
3433 under Subchapter A, Chapter 29, and other measures of student
3534 performance that may be identified through the comprehensive needs
3635 assessment;
3736 (3) strategies for improvement of student performance
3837 that include:
3938 (A) instructional methods for addressing the
4039 needs of student groups not achieving their full potential;
4140 (B) methods for addressing the needs of students
4241 for special programs, including:
4342 (i) suicide prevention programs, in
4443 accordance with Subchapter O-1, Chapter 161, Health and Safety
4544 Code, which includes a parental or guardian notification procedure;
4645 (ii) conflict resolution programs;
4746 (iii) violence prevention programs; and
4847 (iv) dyslexia treatment programs;
4948 (C) dropout reduction;
5049 (D) integration of technology in instructional
5150 and administrative programs;
5251 (E) discipline management;
5352 (F) staff development for professional staff of
5453 the district;
5554 (G) career education to assist students in
5655 developing the knowledge, skills, and competencies necessary for a
5756 broad range of career opportunities; and
5857 (H) accelerated education;
5958 (4) strategies for providing to middle school, junior
6059 high school, and high school students, those students' teachers and
6160 school counselors, and those students' parents information about:
6261 (A) higher education admissions and financial
6362 aid opportunities;
6463 (B) the TEXAS grant program and the Teach for
6564 Texas grant program established under Chapter 56;
6665 (C) the need for students to make informed
6766 curriculum choices to be prepared for success beyond high school;
6867 and
6968 (D) sources of information on higher education
7069 admissions and financial aid;
7170 (5) resources needed to implement identified
7271 strategies;
7372 (6) staff responsible for ensuring the accomplishment
7473 of each strategy;
7574 (7) timelines for ongoing monitoring of the
7675 implementation of each improvement strategy;
7776 (8) formative evaluation criteria for determining
7877 periodically whether strategies are resulting in intended
7978 improvement of student performance; [and]
8079 (9) the policy under Section 38.0041 addressing sexual
8180 abuse and other maltreatment of children; and
8281 (10) the trauma-informed care policy under Section
8382 38.036.
8483 SECTION 2. Sections 21.054(d) and (d-2), Education Code,
8584 are amended to read as follows:
8685 (d) Continuing education requirements for a classroom
8786 teacher must provide that not more than 25 percent of the training
8887 required every five years include instruction regarding:
8988 (1) collecting and analyzing information that will
9089 improve effectiveness in the classroom;
9190 (2) recognizing early warning indicators that a
9291 student may be at risk of dropping out of school;
9392 (3) digital learning, digital teaching, and
9493 integrating technology into classroom instruction;
9594 (4) educating diverse student populations, including:
9695 (A) students with disabilities, including mental
9796 health disorders;
9897 (B) students who are educationally
9998 disadvantaged;
10099 (C) students of limited English proficiency; and
101100 (D) students at risk of dropping out of school;
102101 [and]
103102 (5) understanding appropriate relationships,
104103 boundaries, and communications between educators and students;
105104 and[.]
106105 (6) [(d-2) Continuing education requirements for a
107106 classroom teacher may include instruction regarding] how grief and
108107 trauma affect student learning and behavior and how evidence-based,
109108 grief-informed, and trauma-informed strategies support the
110109 academic success of students affected by grief and trauma.
111110 (d-2) The instruction required under Subsection (d)(6) must
112111 be:
113112 (1) a training program that complies with Section
114113 38.036(c)(1)(A); and
115114 (2) approved by the commissioner.
116115 SECTION 3. Subchapter A, Chapter 38, Education Code, is
117116 amended by adding Section 38.036 to read as follows:
118117 Sec. 38.036. TRAUMA-INFORMED CARE POLICY. (a) Each school
119118 district and open-enrollment charter school shall adopt and
120119 implement a policy requiring the integration of trauma-informed
121120 practices in each school environment.
122121 (b) A policy required by this section must address:
123122 (1) using resources developed by the agency, methods
124123 for:
125124 (A) increasing staff and parent awareness of
126125 trauma-informed care; and
127126 (B) implementation of trauma-informed practices
128127 and care by district and campus staff; and
129128 (2) available counseling options for students
130129 affected by trauma or toxic stress.
131130 (c) The methods under Subsection (b)(1) for increasing
132131 awareness and implementation of trauma-informed care must include
133132 training as provided by this subsection. The training:
134133 (1) must be provided:
135134 (A) through an evidence-based,
136135 evidence-informed, or promising practices training program that
137136 addresses the effects of trauma and is approved by the agency; and
138137 (B) as part of any new employee orientation for
139138 all new school district and open-enrollment charter school
140139 educators or coaches; and
141140 (2) may be provided to existing school district and
142141 open-enrollment charter school educators or coaches on a schedule
143142 recommended by commissioner rule.
144143 (d) For any training provided under Subsection (c), each
145144 school district and open-enrollment charter school shall maintain
146145 records that include the name of each district or charter school
147146 staff member who participated in the training.
148147 (e) If a school district or open-enrollment charter school
149148 determines that the district or charter school does not have
150149 sufficient resources to provide the training required under
151150 Subsection (c), the district or charter school shall make
152151 reasonable efforts to collaborate with a community organization to
153152 provide training that meets the requirements of Subsection (c) at
154153 no cost to the district or charter school.
155154 (f) The commissioner shall adopt rules as necessary to
156155 administer this section.
157156 SECTION 4. This Act applies beginning with the 2019-2020
158157 school year.
159158 SECTION 5. This Act takes effect immediately if it receives
160159 a vote of two-thirds of all the members elected to each house, as
161160 provided by Section 39, Article III, Texas Constitution. If this
162161 Act does not receive the vote necessary for immediate effect, this
163162 Act takes effect September 1, 2019.
