9 | 8 | | open-enrollment charter schools and training regarding the policy |

10 | 9 | | for district and school employees. |
---|
11 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 11 | | SECTION 1. Section 11.252(a), Education Code, is amended to |
---|
13 | 12 | | read as follows: |
---|
14 | 13 | | (a) Each school district shall have a district improvement |
---|
15 | 14 | | plan that is developed, evaluated, and revised annually, in |
---|
16 | 15 | | accordance with district policy, by the superintendent with the |
---|
17 | 16 | | assistance of the district-level committee established under |
---|
18 | 17 | | Section 11.251. The purpose of the district improvement plan is to |
---|
19 | 18 | | guide district and campus staff in the improvement of student |
---|
20 | 19 | | performance for all student groups in order to attain state |
---|
21 | 20 | | standards in respect to the achievement indicators adopted under |
---|
22 | 21 | | Section 39.053(c). The district improvement plan must include |
---|
23 | 22 | | provisions for: |
---|
24 | 23 | | (1) a comprehensive needs assessment addressing |
---|
25 | 24 | | district student performance on the achievement indicators, and |
---|
26 | 25 | | other appropriate measures of performance, that are disaggregated |
---|
27 | 26 | | by all student groups served by the district, including categories |
---|
28 | 27 | | of ethnicity, socioeconomic status, sex, and populations served by |
---|
29 | 28 | | special programs, including students in special education programs |
---|
30 | 29 | | under Subchapter A, Chapter 29; |
---|
31 | 30 | | (2) measurable district performance objectives for |
---|
32 | 31 | | all appropriate achievement indicators for all student |
---|
33 | 32 | | populations, including students in special education programs |
---|
34 | 33 | | under Subchapter A, Chapter 29, and other measures of student |
---|
35 | 34 | | performance that may be identified through the comprehensive needs |
---|
36 | 35 | | assessment; |
---|
37 | 36 | | (3) strategies for improvement of student performance |
---|
38 | 37 | | that include: |
---|
39 | 38 | | (A) instructional methods for addressing the |
---|
40 | 39 | | needs of student groups not achieving their full potential; |
---|
41 | 40 | | (B) methods for addressing the needs of students |
---|
42 | 41 | | for special programs, including: |
---|
43 | 42 | | (i) suicide prevention programs, in |
---|
44 | 43 | | accordance with Subchapter O-1, Chapter 161, Health and Safety |
---|
45 | 44 | | Code, which includes a parental or guardian notification procedure; |
---|
46 | 45 | | (ii) conflict resolution programs; |
---|
47 | 46 | | (iii) violence prevention programs; and |
---|
48 | 47 | | (iv) dyslexia treatment programs; |
---|
49 | 48 | | (C) dropout reduction; |
---|
50 | 49 | | (D) integration of technology in instructional |
---|
51 | 50 | | and administrative programs; |
---|
52 | 51 | | (E) discipline management; |
---|
53 | 52 | | (F) staff development for professional staff of |
---|
54 | 53 | | the district; |
---|
55 | 54 | | (G) career education to assist students in |
---|
56 | 55 | | developing the knowledge, skills, and competencies necessary for a |
---|
57 | 56 | | broad range of career opportunities; and |
---|
58 | 57 | | (H) accelerated education; |
---|
59 | 58 | | (4) strategies for providing to middle school, junior |
---|
60 | 59 | | high school, and high school students, those students' teachers and |
---|
61 | 60 | | school counselors, and those students' parents information about: |
---|
62 | 61 | | (A) higher education admissions and financial |
---|
63 | 62 | | aid opportunities; |
---|
64 | 63 | | (B) the TEXAS grant program and the Teach for |
---|
65 | 64 | | Texas grant program established under Chapter 56; |
---|
66 | 65 | | (C) the need for students to make informed |
---|
67 | 66 | | curriculum choices to be prepared for success beyond high school; |
---|
68 | 67 | | and |
---|
69 | 68 | | (D) sources of information on higher education |
---|
70 | 69 | | admissions and financial aid; |
---|
71 | 70 | | (5) resources needed to implement identified |
---|
72 | 71 | | strategies; |
---|
73 | 72 | | (6) staff responsible for ensuring the accomplishment |
---|
74 | 73 | | of each strategy; |
---|
75 | 74 | | (7) timelines for ongoing monitoring of the |
---|
76 | 75 | | implementation of each improvement strategy; |
---|
77 | 76 | | (8) formative evaluation criteria for determining |
---|
78 | 77 | | periodically whether strategies are resulting in intended |
---|
79 | 78 | | improvement of student performance; [and] |
---|
80 | 79 | | (9) the policy under Section 38.0041 addressing sexual |
---|
81 | 80 | | abuse and other maltreatment of children; and |
---|
82 | 81 | | (10) the trauma-informed care policy under Section |
---|
83 | 82 | | 38.036. |
---|
84 | 83 | | SECTION 2. Sections 21.054(d) and (d-2), Education Code, |
---|
85 | 84 | | are amended to read as follows: |
---|
86 | 85 | | (d) Continuing education requirements for a classroom |
---|
87 | 86 | | teacher must provide that not more than 25 percent of the training |
---|
88 | 87 | | required every five years include instruction regarding: |
---|
89 | 88 | | (1) collecting and analyzing information that will |
---|
90 | 89 | | improve effectiveness in the classroom; |
---|
91 | 90 | | (2) recognizing early warning indicators that a |
---|
92 | 91 | | student may be at risk of dropping out of school; |
---|
93 | 92 | | (3) digital learning, digital teaching, and |
---|
94 | 93 | | integrating technology into classroom instruction; |
---|
95 | 94 | | (4) educating diverse student populations, including: |
---|
96 | 95 | | (A) students with disabilities, including mental |
---|
97 | 96 | | health disorders; |
---|
98 | 97 | | (B) students who are educationally |
---|
99 | 98 | | disadvantaged; |
---|
100 | 99 | | (C) students of limited English proficiency; and |
---|
101 | 100 | | (D) students at risk of dropping out of school; |
---|
102 | 101 | | [and] |
---|
103 | 102 | | (5) understanding appropriate relationships, |
---|
104 | 103 | | boundaries, and communications between educators and students; |
---|
105 | 104 | | and[.] |
---|
106 | 105 | | (6) [(d-2) Continuing education requirements for a |
---|
107 | 106 | | classroom teacher may include instruction regarding] how grief and |
---|
108 | 107 | | trauma affect student learning and behavior and how evidence-based, |
---|
109 | 108 | | grief-informed, and trauma-informed strategies support the |
---|
110 | 109 | | academic success of students affected by grief and trauma. |
---|
111 | 110 | | (d-2) The instruction required under Subsection (d)(6) must |
---|
112 | 111 | | be: |
---|
113 | 112 | | (1) a training program that complies with Section |
---|
114 | 113 | | 38.036(c)(1)(A); and |
---|
115 | 114 | | (2) approved by the commissioner. |
---|
116 | 115 | | SECTION 3. Subchapter A, Chapter 38, Education Code, is |
---|
117 | 116 | | amended by adding Section 38.036 to read as follows: |
---|
118 | 117 | | Sec. 38.036. TRAUMA-INFORMED CARE POLICY. (a) Each school |
---|
119 | 118 | | district and open-enrollment charter school shall adopt and |
---|
120 | 119 | | implement a policy requiring the integration of trauma-informed |
---|
121 | 120 | | practices in each school environment. |
---|
122 | 121 | | (b) A policy required by this section must address: |
---|
123 | 122 | | (1) using resources developed by the agency, methods |
---|
124 | 123 | | for: |
---|
125 | 124 | | (A) increasing staff and parent awareness of |
---|
126 | 125 | | trauma-informed care; and |
---|
127 | 126 | | (B) implementation of trauma-informed practices |
---|
128 | 127 | | and care by district and campus staff; and |
---|
129 | 128 | | (2) available counseling options for students |
---|
130 | 129 | | affected by trauma or toxic stress. |
---|
131 | 130 | | (c) The methods under Subsection (b)(1) for increasing |
---|
132 | 131 | | awareness and implementation of trauma-informed care must include |
---|
133 | 132 | | training as provided by this subsection. The training: |
---|
134 | 133 | | (1) must be provided: |
---|
135 | 134 | | (A) through an evidence-based, |
---|
136 | 135 | | evidence-informed, or promising practices training program that |
---|
137 | 136 | | addresses the effects of trauma and is approved by the agency; and |
---|
138 | 137 | | (B) as part of any new employee orientation for |
---|
139 | 138 | | all new school district and open-enrollment charter school |
---|
140 | 139 | | educators or coaches; and |
---|
141 | 140 | | (2) may be provided to existing school district and |
---|
142 | 141 | | open-enrollment charter school educators or coaches on a schedule |
---|
143 | 142 | | recommended by commissioner rule. |
---|
144 | 143 | | (d) For any training provided under Subsection (c), each |
---|
145 | 144 | | school district and open-enrollment charter school shall maintain |
---|
146 | 145 | | records that include the name of each district or charter school |
---|
147 | 146 | | staff member who participated in the training. |
---|
148 | 147 | | (e) If a school district or open-enrollment charter school |
---|
149 | 148 | | determines that the district or charter school does not have |
---|
150 | 149 | | sufficient resources to provide the training required under |
---|
151 | 150 | | Subsection (c), the district or charter school shall make |
---|
152 | 151 | | reasonable efforts to collaborate with a community organization to |
---|
153 | 152 | | provide training that meets the requirements of Subsection (c) at |
---|
154 | 153 | | no cost to the district or charter school. |
---|
155 | 154 | | (f) The commissioner shall adopt rules as necessary to |
---|
156 | 155 | | administer this section. |
---|
157 | 156 | | SECTION 4. This Act applies beginning with the 2019-2020 |
---|
158 | 157 | | school year. |
---|
159 | 158 | | SECTION 5. This Act takes effect immediately if it receives |
---|
160 | 159 | | a vote of two-thirds of all the members elected to each house, as |
---|
161 | 160 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
162 | 161 | | Act does not receive the vote necessary for immediate effect, this |
---|
163 | 162 | | Act takes effect September 1, 2019. |
