| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 600.003, Transportation |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 600.003. ENFORCEMENT OF [CERTAIN] TRAFFIC LAWS BY |
|---|
| 13 | 13 | | PRIVATE INSTITUTIONS OF HIGHER EDUCATION. |
|---|
| 14 | 14 | | SECTION 2. Section 600.003(b), Transportation Code, is |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (b) A private or independent institution of higher |
|---|
| 17 | 17 | | education may enforce a traffic law of this state [under Chapter 545 |
|---|
| 18 | 18 | | restricting or prohibiting the operation or movement of vehicles] |
|---|
| 19 | 19 | | on a road of the institution if: |
|---|
| 20 | 20 | | (1) the road of the institution is open to the public |
|---|
| 21 | 21 | | at the time the traffic law is enforced; and |
|---|
| 22 | 22 | | (2) the governing body of the institution adopts a |
|---|
| 23 | 23 | | regulation to enforce the traffic law[; and |
|---|
| 24 | 24 | | [(3) the restriction or prohibition on the operation |
|---|
| 25 | 25 | | and movement of vehicles adopted by the institution: |
|---|
| 26 | 26 | | [(A) is posted by means of a sign, marking, |
|---|
| 27 | 27 | | signal, or other device visible to and, if it contains writing, able |
|---|
| 28 | 28 | | to be read by an operator of a vehicle to whom the restriction or |
|---|
| 29 | 29 | | prohibition applies in the same manner as a similar restriction or |
|---|
| 30 | 30 | | prohibition on the operation and movement of vehicles would be |
|---|
| 31 | 31 | | posted by a municipality; and |
|---|
| 32 | 32 | | [(B) has been approved by: |
|---|
| 33 | 33 | | [(i) the commissioners court of the county |
|---|
| 34 | 34 | | in which the applicable road of the institution is located, if the |
|---|
| 35 | 35 | | road is located in the unincorporated area of a county; or |
|---|
| 36 | 36 | | [(ii) the governing body of the |
|---|
| 37 | 37 | | municipality in which the applicable road of the institution is |
|---|
| 38 | 38 | | located, if the road is located in a municipality]. |

| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2019. |
