66 AN ACT
77 relating to the enforcement of traffic laws by private institutions
88 of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 600.003, Transportation
1111 Code, is amended to read as follows:
1212 Sec. 600.003. ENFORCEMENT OF [CERTAIN] TRAFFIC LAWS BY
1313 PRIVATE INSTITUTIONS OF HIGHER EDUCATION.
1414 SECTION 2. Section 600.003(b), Transportation Code, is
1515 amended to read as follows:
1616 (b) A private or independent institution of higher
1717 education may enforce a traffic law of this state [under Chapter 545
1818 restricting or prohibiting the operation or movement of vehicles]
1919 on a road of the institution if:
2020 (1) the road of the institution is open to the public
2121 at the time the traffic law is enforced; and
2222 (2) the governing body of the institution adopts a
2323 regulation to enforce the traffic law[; and
2424 [(3) the restriction or prohibition on the operation
2525 and movement of vehicles adopted by the institution:
2626 [(A) is posted by means of a sign, marking,
2727 signal, or other device visible to and, if it contains writing, able
2828 to be read by an operator of a vehicle to whom the restriction or
2929 prohibition applies in the same manner as a similar restriction or
3030 prohibition on the operation and movement of vehicles would be
3131 posted by a municipality; and
3232 [(B) has been approved by:
3333 [(i) the commissioners court of the county
3434 in which the applicable road of the institution is located, if the
3535 road is located in the unincorporated area of a county; or
3636 [(ii) the governing body of the
3737 municipality in which the applicable road of the institution is
3838 located, if the road is located in a municipality].
3939 SECTION 3. This Act takes effect September 1, 2019.
