| 7 | 7 | | relating to the use of the law enforcement officer standards and |

| 8 | 8 | | education fund for continuing education expenses of law enforcement |

| 9 | 9 | | personnel at private or independent institutions of higher |
|---|
| 10 | 10 | | education. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 1701.157, Occupations Code, is amended |
|---|
| 13 | 13 | | by amending Subsection (a) and adding Subsection (f) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (a) Not later than March 1 of each calendar year, the |
|---|
| 16 | 16 | | comptroller shall allocate money deposited during the preceding |
|---|
| 17 | 17 | | calendar year in the general revenue fund to the credit of the law |
|---|
| 18 | 18 | | enforcement officer standards and education fund account for |
|---|
| 19 | 19 | | expenses related to the continuing education of persons licensed |
|---|
| 20 | 20 | | under this chapter as follows: |
|---|
| 21 | 21 | | (1) 20 percent of the money is allocated to all local |
|---|
| 22 | 22 | | law enforcement agencies in this state in equal shares; and |
|---|
| 23 | 23 | | (2) 80 percent of the money is allocated to all local |
|---|
| 24 | 24 | | law enforcement agencies in this state in a share representing a |
|---|
| 25 | 25 | | fixed amount for each position in the agency, as of January 1 of the |
|---|
| 26 | 26 | | preceding calendar year, that is reserved to a person who: |
|---|
| 27 | 27 | | (A) is licensed under this chapter; |
|---|
| 28 | 28 | | (B) works as a peace officer or telecommunicator, |
|---|
| 29 | 29 | | as defined by Section 1701.001, on the average of at least 32 hours |
|---|
| 30 | 30 | | a week; and |
|---|
| 31 | 31 | | (C) is compensated by a political subdivision of |
|---|
| 32 | 32 | | this state or a private or independent institution of higher |
|---|
| 33 | 33 | | education at least at the minimum wage and is entitled to all |
|---|
| 34 | 34 | | employee benefits offered to a peace officer or telecommunicator, |
|---|
| 35 | 35 | | as applicable, by the political subdivision or institution. |
|---|
| 36 | 36 | | (f) In this section: |
|---|
| 37 | 37 | | (1) "Local law enforcement agency" includes a law |
|---|
| 38 | 38 | | enforcement agency of a private or independent institution of |
|---|
| 39 | 39 | | higher education. |
|---|
| 40 | 40 | | (2) "Private or independent institution of higher |
|---|
| 41 | 41 | | education" has the meaning assigned by Section 61.003, Education |
|---|
| 42 | 42 | | Code. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2019. |
