55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of the law enforcement officer standards and
88 education fund for continuing education expenses of law enforcement
99 personnel at private or independent institutions of higher
1010 education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1701.157, Occupations Code, is amended
1313 by amending Subsection (a) and adding Subsection (f) to read as
1414 follows:
1515 (a) Not later than March 1 of each calendar year, the
1616 comptroller shall allocate money deposited during the preceding
1717 calendar year in the general revenue fund to the credit of the law
1818 enforcement officer standards and education fund account for
1919 expenses related to the continuing education of persons licensed
2020 under this chapter as follows:
2121 (1) 20 percent of the money is allocated to all local
2222 law enforcement agencies in this state in equal shares; and
2323 (2) 80 percent of the money is allocated to all local
2424 law enforcement agencies in this state in a share representing a
2525 fixed amount for each position in the agency, as of January 1 of the
2626 preceding calendar year, that is reserved to a person who:
2727 (A) is licensed under this chapter;
2828 (B) works as a peace officer or telecommunicator,
2929 as defined by Section 1701.001, on the average of at least 32 hours
3030 a week; and
3131 (C) is compensated by a political subdivision of
3232 this state or a private or independent institution of higher
3333 education at least at the minimum wage and is entitled to all
3434 employee benefits offered to a peace officer or telecommunicator,
3535 as applicable, by the political subdivision or institution.
3636 (f) In this section:
3737 (1) "Local law enforcement agency" includes a law
3838 enforcement agency of a private or independent institution of
3939 higher education.
4040 (2) "Private or independent institution of higher
4141 education" has the meaning assigned by Section 61.003, Education
4242 Code.
4343 SECTION 2. This Act takes effect September 1, 2019.
