66 AN ACT
77 relating to conditions of community supervision prohibiting
88 contact with certain persons.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter G, Chapter 42A, Code of Criminal
1111 Procedure, is amended by adding Article 42A.3015 to read as
1212 follows:
1313 Art. 42A.3015. PROHIBITING CONTACT WITH CERTAIN PERSONS. A
1414 judge who places a defendant on community supervision may not, as a
1515 condition of community supervision, prohibit the defendant from
1616 contacting or interacting with a person who belongs to an
1717 organization the membership of which includes persons who have
1818 criminal histories, including persons currently on community
1919 supervision or parole, and who engages in activities that the
2020 director of the community supervision and corrections department
2121 supervising the defendant determines, based on information
2222 provided by the organization's designated representative or other
2323 information, include:
2424 (1) working with community members to address criminal
2525 justice issues;
2626 (2) offering training and programs to assist formerly
2727 incarcerated persons; and
2828 (3) advocating for criminal justice reform, including
2929 by:
3030 (A) engaging with state and local policy makers;
3131 or
3232 (B) participating in a lawful manner in rallies,
3333 marches, or other public displays of organized activity.
3434 SECTION 2. The change in law made by this Act applies to a
3535 defendant placed on community supervision on or after the effective
3636 date of this Act, regardless of whether the offense for which the
3737 defendant was placed on community supervision was committed before,
3838 on, or after the effective date of this Act.
3939 SECTION 3. This Act takes effect September 1, 2019.
