| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter G, Chapter 42A, Code of Criminal |
|---|
| 11 | 11 | | Procedure, is amended by adding Article 42A.3015 to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | Art. 42A.3015. PROHIBITING CONTACT WITH CERTAIN PERSONS. A |
|---|
| 14 | 14 | | judge who places a defendant on community supervision may not, as a |
|---|
| 15 | 15 | | condition of community supervision, prohibit the defendant from |
|---|
| 16 | 16 | | contacting or interacting with a person who belongs to an |
|---|
| 17 | 17 | | organization the membership of which includes persons who have |
|---|
| 18 | 18 | | criminal histories, including persons currently on community |
|---|
| 19 | 19 | | supervision or parole, and who engages in activities that the |
|---|
| 20 | 20 | | director of the community supervision and corrections department |
|---|
| 21 | 21 | | supervising the defendant determines, based on information |
|---|
| 22 | 22 | | provided by the organization's designated representative or other |
|---|
| 23 | 23 | | information, include: |
|---|
| 24 | 24 | | (1) working with community members to address criminal |
|---|
| 25 | 25 | | justice issues; |
|---|
| 26 | 26 | | (2) offering training and programs to assist formerly |
|---|
| 27 | 27 | | incarcerated persons; and |
|---|
| 28 | 28 | | (3) advocating for criminal justice reform, including |
|---|
| 29 | 29 | | by: |
|---|
| 30 | 30 | | (A) engaging with state and local policy makers; |
|---|
| 31 | 31 | | or |
|---|
| 32 | 32 | | (B) participating in a lawful manner in rallies, |
|---|
| 33 | 33 | | marches, or other public displays of organized activity. |
|---|
| 34 | 34 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 35 | 35 | | defendant placed on community supervision on or after the effective |
|---|
| 36 | 36 | | date of this Act, regardless of whether the offense for which the |
|---|
| 37 | 37 | | defendant was placed on community supervision was committed before, |
|---|
| 38 | 38 | | on, or after the effective date of this Act. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2019. |
