55 AN ACT
66 relating to the requirements for and compilation of certain
77 emergency mental health detention records.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 573.002(b) and (d), Health and Safety
1010 Code, are amended to read as follows:
1111 (b) The notification of detention must contain:
1212 (1) a statement that the officer has reason to believe
1313 and does believe that the person evidences mental illness;
1414 (2) a statement that the officer has reason to believe
1515 and does believe that the person evidences a substantial risk of
1616 serious harm to the person or others;
1717 (3) a specific description of the risk of harm;
1818 (4) a statement that the officer has reason to believe
1919 and does believe that the risk of harm is imminent unless the person
2020 is immediately restrained;
2121 (5) a statement that the officer's beliefs are derived
2222 from specific recent behavior, overt acts, attempts, or threats
2323 that were observed by or reliably reported to the officer;
2424 (6) a detailed description of the specific behavior,
2525 acts, attempts, or threats; [and]
2626 (7) the name and relationship to the apprehended
2727 person of any person who reported or observed the behavior, acts,
2828 attempts, or threats;
2929 (8) a description of the place and setting where the
3030 detention was initiated; and
3131 (9) the age, race, gender, and other demographic
3232 information required by rule of the executive commissioner.
3333 (d) The peace officer shall provide the notification of
3434 detention on the following form:

9191 A mental health facility or hospital emergency department may
9292 not require a peace officer or emergency medical services personnel
9393 to execute any form other than this form as a predicate to accepting
9494 for temporary admission a person detained by a peace officer under
9595 Section 573.001, Health and Safety Code, and transported by the
9696 officer under that section or by emergency medical services
9797 personnel of an emergency medical services provider at the request
9898 of the officer made in accordance with a memorandum of
9999 understanding executed under Section 573.005, Health and Safety
100100 Code.
101101 SECTION 2. Section 573.021, Health and Safety Code, is
102102 amended by adding Subsection (f) to read as follows:
103103 (f) A facility that accepts a person for preliminary
104104 examination under Subsection (a), as soon as practicable but not
105105 more than 12 hours after the person is accepted to the facility,
106106 shall submit to each court with jurisdiction to order commitment
107107 under Chapter 574 a copy of the peace officer's notification of
108108 detention filed with the facility under Section 573.002.
109109 SECTION 3. The heading to Section 574.014, Health and
110110 Safety Code, is amended to read as follows:
111111 Sec. 574.014. COMPILATION OF MENTAL HEALTH COMMITMENT AND
112112 EMERGENCY DETENTION RECORDS.
113113 SECTION 4. Section 574.014(a), Health and Safety Code, is
114114 amended to read as follows:
115115 (a) The clerk of each court with jurisdiction to order
116116 commitment under this chapter shall provide the Office of Court
117117 Administration each month with a report of the number of peace
118118 officer's notification of detention forms submitted to the court
119119 under Section 573.021(f) and the number of applications for
120120 commitment orders for involuntary mental health services filed with
121121 the court and the disposition of those cases, including the number
122122 of commitment orders for inpatient and outpatient mental health
123123 services. The Office of Court Administration annually shall make
124124 the reported information available to the Health and Human Services
125125 Commission [department annually].
126126 SECTION 5. The changes in law made by this Act apply only to
127127 an emergency detention that begins on or after the effective date of
128128 this Act. An emergency detention that begins before the effective
129129 date of this Act is governed by the law as it existed immediately
130130 before the effective date of this Act, and that law is continued in
131131 effect for that purpose.
132132 SECTION 6. This Act takes effect September 1, 2019.
