9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter H, Chapter 418, Government Code, is |
---|
11 | 11 | | amended by adding Section 418.193 to read as follows: |
---|
12 | 12 | | Sec. 418.193. ATTORNEY GENERAL AS LEGAL ADVISOR ON ISSUES |
---|
13 | 13 | | RELATED TO DECLARED DISASTER. (a) This section applies only during |
---|
14 | 14 | | a declared state of disaster under Section 418.014 and the 90-day |
---|
15 | 15 | | period following the expiration or termination of the disaster |
---|
16 | 16 | | declaration. |
---|
17 | 17 | | (b) The attorney general may provide legal counsel to a |
---|
18 | 18 | | political subdivision subject to a declared state of disaster under |
---|
19 | 19 | | Section 418.014 on issues related to disaster mitigation, |
---|
20 | 20 | | preparedness, response, and recovery applicable to the area subject |
---|
21 | 21 | | to the disaster declaration. |
---|
22 | 22 | | (c) A request for counsel under this section may be |
---|
23 | 23 | | submitted only by: |
---|
24 | 24 | | (1) the emergency management director designated |
---|
25 | 25 | | under Section 418.1015 for the political subdivision; |
---|
26 | 26 | | (2) the county judge or a commissioner of a county |
---|
27 | 27 | | subject to the declaration; or |
---|
28 | 28 | | (3) the mayor of a municipality subject to the |
---|
29 | 29 | | declaration. |
---|
30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
---|
31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
---|
32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
---|
34 | 34 | | Act takes effect September 1, 2019. |
