55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to legal counsel provided by the attorney general to a
88 political subdivision subject to a declared state of disaster.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 418, Government Code, is
1111 amended by adding Section 418.193 to read as follows:
1212 Sec. 418.193. ATTORNEY GENERAL AS LEGAL ADVISOR ON ISSUES
1313 RELATED TO DECLARED DISASTER. (a) This section applies only during
1414 a declared state of disaster under Section 418.014 and the 90-day
1515 period following the expiration or termination of the disaster
1616 declaration.
1717 (b) The attorney general may provide legal counsel to a
1818 political subdivision subject to a declared state of disaster under
1919 Section 418.014 on issues related to disaster mitigation,
2020 preparedness, response, and recovery applicable to the area subject
2121 to the disaster declaration.
2222 (c) A request for counsel under this section may be
2323 submitted only by:
2424 (1) the emergency management director designated
2525 under Section 418.1015 for the political subdivision;
2626 (2) the county judge or a commissioner of a county
2727 subject to the declaration; or
2828 (3) the mayor of a municipality subject to the
2929 declaration.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2019.
