66 AN ACT
77 relating to the enrollment and reimbursement of psychological
88 associates under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.024, Human Resources Code, is amended
1111 by adding Subsection (ll) to read as follows:
1212 (ll) The executive commissioner shall establish a separate
1313 provider type for psychological associates licensed under Chapter
1414 501, Occupations Code, for purposes of enrollment as a provider for
1515 and reimbursement under the medical assistance program.
1616 SECTION 2. Section 32.027(l), Human Resources Code, is
1717 amended to read as follows:
1818 (l) Subject to appropriations, the commission shall assure
1919 that a recipient of medical assistance under this chapter may
2020 select a licensed psychologist, a licensed psychological
2121 associate, a licensed marriage and family therapist, as defined by
2222 Section 502.002, Occupations Code, a licensed professional
2323 counselor, as defined by Section 503.002, Occupations Code, or a
2424 licensed master social worker, as defined by Section 505.002,
2525 Occupations Code, to perform any health care service or procedure
2626 covered under the medical assistance program if the selected person
2727 is authorized by law to perform the service or procedure. This
2828 subsection shall be liberally construed.
2929 SECTION 3. Section 1451.001(18), Insurance Code, is amended
3030 to read as follows:
3131 (18) "Psychological associate" means an individual
3232 licensed as a psychological associate by the Texas State Board of
3333 Examiners of Psychologists [who practices solely under the
3434 supervision of a licensed psychologist].
3535 SECTION 4. The Texas State Board of Examiners of
3636 Psychologists shall adopt any rules necessary to implement the
3737 changes made by this Act.
3838 SECTION 5. If, before implementing any provision of this
3939 Act, a state agency determines that a waiver or authorization from a
4040 federal agency is necessary for implementation of that provision,
4141 the agency affected by the provision shall request the waiver or
4242 authorization and may delay implementing that provision until the
4343 waiver or authorization is granted.
4444 SECTION 6. This Act takes effect September 1, 2019.
