| 7 | 7 | | relating to the enrollment and reimbursement of psychological |

| 8 | 8 | | associates under Medicaid. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 32.024, Human Resources Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (ll) to read as follows: |
|---|
| 12 | 12 | | (ll) The executive commissioner shall establish a separate |
|---|
| 13 | 13 | | provider type for psychological associates licensed under Chapter |
|---|
| 14 | 14 | | 501, Occupations Code, for purposes of enrollment as a provider for |
|---|
| 15 | 15 | | and reimbursement under the medical assistance program. |
|---|
| 16 | 16 | | SECTION 2. Section 32.027(l), Human Resources Code, is |
|---|
| 17 | 17 | | amended to read as follows: |
|---|
| 18 | 18 | | (l) Subject to appropriations, the commission shall assure |
|---|
| 19 | 19 | | that a recipient of medical assistance under this chapter may |
|---|
| 20 | 20 | | select a licensed psychologist, a licensed psychological |
|---|
| 21 | 21 | | associate, a licensed marriage and family therapist, as defined by |
|---|
| 22 | 22 | | Section 502.002, Occupations Code, a licensed professional |
|---|
| 23 | 23 | | counselor, as defined by Section 503.002, Occupations Code, or a |
|---|
| 24 | 24 | | licensed master social worker, as defined by Section 505.002, |
|---|
| 25 | 25 | | Occupations Code, to perform any health care service or procedure |
|---|
| 26 | 26 | | covered under the medical assistance program if the selected person |
|---|
| 27 | 27 | | is authorized by law to perform the service or procedure. This |
|---|
| 28 | 28 | | subsection shall be liberally construed. |
|---|
| 29 | 29 | | SECTION 3. Section 1451.001(18), Insurance Code, is amended |
|---|
| 30 | 30 | | to read as follows: |
|---|
| 31 | 31 | | (18) "Psychological associate" means an individual |
|---|
| 32 | 32 | | licensed as a psychological associate by the Texas State Board of |
|---|
| 33 | 33 | | Examiners of Psychologists [who practices solely under the |
|---|
| 34 | 34 | | supervision of a licensed psychologist]. |
|---|
| 35 | 35 | | SECTION 4. The Texas State Board of Examiners of |
|---|
| 36 | 36 | | Psychologists shall adopt any rules necessary to implement the |
|---|
| 37 | 37 | | changes made by this Act. |
|---|
| 38 | 38 | | SECTION 5. If, before implementing any provision of this |
|---|
| 39 | 39 | | Act, a state agency determines that a waiver or authorization from a |
|---|
| 40 | 40 | | federal agency is necessary for implementation of that provision, |
|---|
| 41 | 41 | | the agency affected by the provision shall request the waiver or |
|---|
| 42 | 42 | | authorization and may delay implementing that provision until the |
|---|
| 43 | 43 | | waiver or authorization is granted. |
|---|
| 44 | 44 | | SECTION 6. This Act takes effect September 1, 2019. |
