| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Subchapter D, Chapter 109, Alcoholic Beverage |
|---|
| 9 | 15 | | Code, is amended by adding Section 109.541 to read as follows: |
|---|
| 10 | 16 | | Sec. 109.541. TASTINGS AT CERTAIN FESTIVALS AND CIVIC |
|---|
| 11 | 17 | | CELEBRATIONS. A person who holds a license or permit to manufacture |
|---|
| 12 | 18 | | alcoholic beverages in this state may conduct product tastings |
|---|
| 13 | 19 | | without the issuance of another license or permit under this code if |
|---|
| 14 | 20 | | those tastings are conducted: |
|---|
| 15 | 21 | | (1) as part of and under the direction of the "Go |
|---|
| 16 | 22 | | Texan" Partner Program under Chapter 46, Agriculture Code; and |
|---|
| 17 | 23 | | (2) during a festival or civic celebration that: |
|---|
| 18 | 24 | | (A) has been held near-annually for at least 100 |
|---|
| 19 | 25 | | years; and |
|---|
| 20 | 26 | | (B) is at least 21 days long. |
|---|
| 21 | 27 | | SECTION 2. This Act takes effect September 1, 2019. |
