| 7 | 7 | | relating to the transportation of municipal solid waste in certain |
|---|
| 8 | 8 | | enclosed vehicles. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 361.091(i), Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (i) This section does not apply to: |
|---|
| 13 | 13 | | (1) a stationary compactor that is at a specific |
|---|
| 14 | 14 | | location and that has an annual permit under this section issued by |
|---|
| 15 | 15 | | the commission, on certification to the commission by the generator |
|---|
| 16 | 16 | | that the contents of the compactor are free of putrescible, |
|---|
| 17 | 17 | | hazardous, or infectious waste; |
|---|
| 18 | 18 | | (2) an enclosed vehicle that is a utility trailer, |
|---|
| 19 | 19 | | van, box van, or receiver box; or |
|---|
| 20 | 20 | | (3) [(2)] an enclosed vehicle of a municipality if the |
|---|
| 21 | 21 | | vehicle has a permit issued by the commission to transport brush or |
|---|
| 22 | 22 | | construction-demolition waste and rubbish on designated dates, on |
|---|
| 23 | 23 | | certification by the municipality to the commission that the |
|---|
| 24 | 24 | | contents of the vehicle are free of putrescible, hazardous, or |
|---|
| 25 | 25 | | infectious waste. |

| 26 | 26 | | SECTION 2. Section 7.161(c), Water Code, is amended to read |
|---|
| 27 | 27 | | as follows: |
|---|
| 28 | 28 | | (c) This section does not apply to: |
|---|
| 29 | 29 | | (1) a stationary compactor that is at a specific |
|---|
| 30 | 30 | | location and that has an annual permit under Section 361.091, |
|---|
| 31 | 31 | | Health and Safety Code, issued by the commission, on certification |
|---|
| 32 | 32 | | to the commission by the generator that the contents of the |
|---|

| 42 | 42 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 43 | 43 | | to an offense committed on or after the effective date of this Act. |
|---|
| 44 | 44 | | An offense committed before the effective date of this Act is |
|---|
| 45 | 45 | | governed by the law in effect on the date the offense was committed, |
|---|
| 46 | 46 | | and the former law is continued in effect for that purpose. For |
|---|
| 47 | 47 | | purposes of this section, an offense was committed before the |
|---|
| 48 | 48 | | effective date of this Act if any element of the offense occurred |
|---|
| 49 | 49 | | before that date. |
|---|
| 50 | 50 | | SECTION 4. This Act takes effect September 1, 2019. |
