55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the transportation of municipal solid waste in certain
88 enclosed vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 361.091(i), Health and Safety Code, is
1111 amended to read as follows:
1212 (i) This section does not apply to:
1313 (1) a stationary compactor that is at a specific
1414 location and that has an annual permit under this section issued by
1515 the commission, on certification to the commission by the generator
1616 that the contents of the compactor are free of putrescible,
1717 hazardous, or infectious waste;
1818 (2) an enclosed vehicle that is a utility trailer,
1919 van, box van, or receiver box; or
2020 (3) [(2)] an enclosed vehicle of a municipality if the
2121 vehicle has a permit issued by the commission to transport brush or
2222 construction-demolition waste and rubbish on designated dates, on
2323 certification by the municipality to the commission that the
2424 contents of the vehicle are free of putrescible, hazardous, or
2525 infectious waste.
2626 SECTION 2. Section 7.161(c), Water Code, is amended to read
2727 as follows:
2828 (c) This section does not apply to:
2929 (1) a stationary compactor that is at a specific
3030 location and that has an annual permit under Section 361.091,
3131 Health and Safety Code, issued by the commission, on certification
3232 to the commission by the generator that the contents of the
3333 compactor are free of putrescible, hazardous, or infectious waste;
3434 (2) an enclosed vehicle that is a utility trailer,
3535 van, box van, or receiver box; or
3636 (3) [(2)] an enclosed vehicle of a municipality if the
3737 vehicle has a permit issued by the commission to transport brush or
3838 construction-demolition waste and rubbish on designated dates, on
3939 certification by the municipality to the commission that the
4040 contents of the vehicle are free of putrescible, hazardous, or
4141 infectious waste.
4242 SECTION 3. The change in law made by this Act applies only
4343 to an offense committed on or after the effective date of this Act.
4444 An offense committed before the effective date of this Act is
4545 governed by the law in effect on the date the offense was committed,
4646 and the former law is continued in effect for that purpose. For
4747 purposes of this section, an offense was committed before the
4848 effective date of this Act if any element of the offense occurred
4949 before that date.
5050 SECTION 4. This Act takes effect September 1, 2019.
