69 relating to a study conducted by counties on the effectiveness of
710 establishing a family drug court; establishing a family drug court
811 grant program.
912 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1013 SECTION 1. Chapter 122, Government Code, is amended by
1114 adding Sections 122.005 and 122.006 to read as follows:
12- Sec. 122.005. FAMILY DRUG COURT STUDY. (a) The
13- commissioners court of a county that has not established a family
14- drug court program may conduct a study of the effect the creation of
15- a family drug court would have in the county. If the commissioners
16- court conducts a study under this section, the sheriff and, as
17- applicable, the county attorney, district attorney, or criminal
18- district attorney shall assist in conducting the study.
19- (b) A commissioners court that conducts a study under this
20- section shall request assistance from the following persons located
21- in the county:
15+ Sec. 122.005. FAMILY DRUG COURT STUDY. (a) Not later than
16+ September 1, 2020, the commissioners court of each county that has
17+ not established a family drug court program shall study the effect
18+ the creation of a family drug court would have in the county. The
19+ sheriff and, as applicable, the county attorney, district attorney,
20+ or criminal district attorney shall assist in conducting the study.
21+ (b) Each commissioners court in a county conducting the
22+ study required by Subsection (a) shall request assistance from the
23+ following persons located in the county:
2224 (1) judges;
2325 (2) child protective services caseworkers and
2426 supervisors;
2527 (3) attorneys ad litem;
2628 (4) guardians ad litem;
2729 (5) drug treatment providers;
2830 (6) family and child therapists;
2931 (7) peer recovery coach providers;
3032 (8) domestic violence victim advocates;
3133 (9) housing partners;
3234 (10) drug coordinators;
3335 (11) drug court services managers; and
3436 (12) drug court case managers.
35- (c) A study conducted under this section must analyze the
36- effectiveness of:

3738 (1) creating a court that specializes in cases in
3839 which a parent or person standing in parental relation suffers from
3940 drug addiction; and
4041 (2) case management used by a family drug court
4142 program, including the involvement of Department of Family and
4243 Protective Services caseworkers, court-appointed case managers,
4344 and court-appointed special advocates, to rehabilitate a parent or
4445 person standing in parental relation who has had a child removed
4546 from the parent's or person's care by the department or who is under
4647 investigation to determine if a child should be removed from the
4748 parent's or person's care by the department.
4849 (d) This section expires January 1, 2021.
4950 Sec. 122.006. GRANT FUNDING FOR FAMILY DRUG COURTS. (a)
5051 The family drug court fund is a dedicated account in the general
5152 revenue fund in the state treasury.
5253 (b) The family drug court fund consists of:
5354 (1) appropriations of money to the fund by the
5455 legislature; and
5556 (2) gifts, grants, including grants from the federal
5657 government, and other donations received for the fund.
5758 (c) The Health and Human Services Commission shall
5859 administer the family drug court fund. Money in the account may be
5960 used only to award grants to counties to establish and administer a
6061 family drug court. To receive money from the family drug court fund
6162 a county must submit the study conducted under Section 122.005 on
6263 the effect of the creation of a family drug court in the county and a
6364 detailed proposal of the establishment of the court.
6465 SECTION 2. The Health and Human Services Commission shall
6566 adopt rules establishing the criteria for awarding a grant to
6667 counties to establish a family drug court under Section 122.006,
6768 Government Code, as added by this Act, not later than January 1,
6869 2020.
6970 SECTION 3. This Act takes effect September 1, 2019.
