44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the prosecution of the criminal offense of organized
77 retail theft.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 31.16(b), Penal Code, is amended to read
1010 as follows:
1111 (b) A person commits an offense if the person intentionally
1212 conducts, promotes, or facilitates an activity in which the person
1313 [receives, possesses, conceals,] stores, barters, or sells[, or
1414 disposes of]:
1515 (1) stolen retail merchandise; or
1616 (2) merchandise explicitly represented to the person
1717 as being stolen retail merchandise.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an offense committed on or after the effective date of this Act.
2020 An offense committed before the effective date of this Act is
2121 governed by the law in effect on the date the offense was committed,
2222 and the former law is continued in effect for that purpose. For
2323 purposes of this section, an offense was committed before the
2424 effective date of this Act if any element of the offense occurred
2525 before that date.
2626 SECTION 3. This Act takes effect September 1, 2019.
