| 7 | 7 | | relating to mental health training for public school educators. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 38.041 to read as follows: |
|---|
| 11 | 11 | | Sec. 38.041. MENTAL HEALTH TRAINING. (a) The commissioner |
|---|
| 12 | 12 | | shall approve a course of instruction for educators that provides |
|---|
| 13 | 13 | | not less than four hours of mental health training. |
|---|
| 14 | 14 | | (b) The commissioner by rule shall require each educator to |
|---|
| 15 | 15 | | complete the course of instruction approved under Subsection (a) |
|---|
| 16 | 16 | | during the week before the first day of classes. |
|---|
| 17 | 17 | | (c) The agency may provide the course of instruction |
|---|
| 18 | 18 | | required by this section using funds available for that purpose. |
|---|
| 19 | 19 | | SECTION 2. Not later than January 1, 2020, the commissioner |
|---|
| 20 | 20 | | of education shall adopt rules required by Section 38.041, |
|---|
| 21 | 21 | | Education Code, as added by this Act, regarding educator mental |
|---|
| 22 | 22 | | health training. |
|---|
| 23 | 23 | | SECTION 3. This Act applies beginning with the 2019-2020 |
|---|
| 24 | 24 | | school year. |
|---|
| 25 | 25 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2019. |
