66 AN ACT
77 relating to mental health training for public school educators.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1010 amended by adding Section 38.041 to read as follows:
1111 Sec. 38.041. MENTAL HEALTH TRAINING. (a) The commissioner
1212 shall approve a course of instruction for educators that provides
1313 not less than four hours of mental health training.
1414 (b) The commissioner by rule shall require each educator to
1515 complete the course of instruction approved under Subsection (a)
1616 during the week before the first day of classes.
1717 (c) The agency may provide the course of instruction
1818 required by this section using funds available for that purpose.
1919 SECTION 2. Not later than January 1, 2020, the commissioner
2020 of education shall adopt rules required by Section 38.041,
2121 Education Code, as added by this Act, regarding educator mental
2222 health training.
2323 SECTION 3. This Act applies beginning with the 2019-2020
2424 school year.
2525 SECTION 4. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2019.
