9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 35, Water Code, is amended by adding | |
11 | 11 | Section 35.0075 to read as follows: | |
12 | 12 | Sec. 35.0075. PRIORITY GROUNDWATER MANAGEMENT AREA STUDY IN | |
13 | 13 | CERTAIN AREAS. (a) This section applies to a county: | |
14 | 14 | (1) bordering the Rio Grande; | |
15 | 15 | (2) overlying the Edwards-Trinity Aquifer; and | |
16 | 16 | (3) with a population greater than 40,000. | |
17 | 17 | (b) For a groundwater conservation district created in a | |
18 | 18 | county to which this section applies, the board shall use the | |
19 | 19 | priority groundwater management area study to set the modeled | |
20 | 20 | available groundwater and the district shall use the priority | |
21 | 21 | groundwater management area study to set the desired future | |
22 | 22 | condition according to the provisions of Chapter 36. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2019. |
