55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the storage, transportation, processing, and disposal
88 of scrap tires.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 361.085, Health and Safety Code, is
1111 amended by amending Subsections (k) and (l) and adding Subsections
1212 (k-1) and (m) to read as follows:
1313 (k) The commission shall require a bond or other financial
1414 assurance as a condition of issuing a registration for the
1515 transportation, storage, or processing of scrap tires, as that term
1616 is defined in Section 361.112. The amount of the bond or other
1717 financial assurance required must be sufficient to cover the
1818 reasonable expenses of an immediate remedial or removal action
1919 under Section 361.1125.
2020 (k-1) A registered tire processor utilizing the tires for
2121 energy recovery at an on-site cement kiln and other energy recovery
2222 facilities the commission identifies by rule are not required to
2323 provide financial assurance under this section.
2424 (l) The commission may require financial assurance as
2525 a condition of issuing a permit or registration for the collection,
2626 transportation, or processing of grit trap waste or grease trap
2727 waste. The amount of financial assurance required must be
2828 consistent with the degree and duration of risk associated with the
2929 type of waste authorized to be collected, transported, or
3030 processed.
3131 (m) [(l)] If the commission requires financial
3232 assurance as a condition of a permit or registration under
3333 Subsection (l) [(k)], provision of that financial assurance also
3434 satisfies any requirement for financial assurance under Chapter
3535 368.
3636 SECTION 2. Section 361.112, Health and Safety Code, is
3737 amended by adding Subsections (g-1) and (g-2) to read as follows:
3838 (g-1) The commission shall issue a registration insignia to
3939 each transporter. The transporter shall display the insignia on
4040 each vehicle used to transport tires under the registration. The
4141 insignia expires annually on a date specified by the commission.
4242 The commission may adopt rules for issuing duplicate and multiple
4343 insignia.
4444 (g-2) The commission shall require a transporter to submit
4545 an annual report on the records maintained by the transporter to the
4646 commission in an electronic format using a form developed by the
4747 commission. A transporter who fails to submit an annual report
4848 under this subsection is not eligible to receive the annual
4949 registration insignia and is subject to revocation of the
5050 registration.
5151 SECTION 3. This Act takes effect September 1, 2019.
