410 AN ACT
511 relating to granting limited state law enforcement authority to
612 certain federal officers or agents.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Articles 2.122(a) and (b), Code of Criminal
915 Procedure, are amended to read as follows:
1016 (a) The following named criminal investigators of the
1117 United States shall not be deemed peace officers, but shall have the
1218 powers of arrest, search, and seizure under the laws of this state
1319 as to felony offenses only:
1420 (1) Special Agents of the Federal Bureau of
1521 Investigation;
1622 (2) Special Agents of the Secret Service;
1723 (3) Special Agents of the United States Immigration
1824 and Customs Enforcement;
1925 (4) Special Agents of the Bureau of Alcohol, Tobacco,
2026 Firearms and Explosives;
2127 (5) Special Agents of the United States Drug
2228 Enforcement Administration;
2329 (6) Inspectors of the United States Postal Inspection
2430 Service;
2531 (7) Special Agents of the Criminal Investigation
2632 Division of the Internal Revenue Service;
2733 (8) Civilian Special Agents of the United States Naval
2834 Criminal Investigative Service;
2935 (9) Marshals and Deputy Marshals of the United States
3036 Marshals Service;
3137 (10) Special Agents of the United States Department of
3238 State, Bureau of Diplomatic Security;
3339 (11) Special Agents of the Treasury Inspector General
3440 for Tax Administration;
3541 (12) Special Agents of the Office of Inspector General
3642 of the United States Social Security Administration;
3743 (13) Special Agents of the Office of Inspector General
3844 of the United States Department of Veterans Affairs;
3945 (14) Special Agents of the Office of Inspector General
4046 of the United States Department of Agriculture; and
4147 (15) [(14)] a police officer with the Office of
4248 Security and Law Enforcement of the United States Department of
4349 Veterans Affairs.
4450 (b) An officer or agent [A person] designated by the
4551 Secretary of Homeland Security [as a special policeman by the
4652 Federal Protective Services division of the General Services
4753 Administration] under 40 U.S.C. Section 1315 for duty in connection
4854 with the protection of property owned or occupied by the federal
4955 government and persons on the property [318 or 318d] is not a peace
5056 officer but has the powers of arrest and search and seizure as to
5157 any offense under the laws of this state.
5258 SECTION 2. This Act takes effect immediately if it receives
5359 a vote of two-thirds of all the members elected to each house, as
5460 provided by Section 39, Article III, Texas Constitution. If this
5561 Act does not receive the vote necessary for immediate effect, this
5662 Act takes effect September 1, 2019.
