77 relating to the Texas Alternatives to Abortion Program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1010 amended by adding Chapter 50 to read as follows:
1111 CHAPTER 50. ALTERNATIVES TO ABORTION PROGRAM
1212 Sec. 50.0001. DEFINITIONS. In this chapter:
1313 (1) "Abortion" has the meaning assigned by Section
1414 245.002.
1515 (2) "Program" means the Texas Alternatives to Abortion
1616 Program established under this chapter.
1717 Sec. 50.0002. ESTABLISHMENT. (a) The commission shall
1818 establish the Texas Alternatives to Abortion Program to enhance and
1919 increase resources that promote childbirth for women facing
2020 unplanned pregnancies.
2121 (b) The commission shall establish a statewide network of
2222 service providers, including pregnancy support centers, adoption
2323 assistance providers, and maternity homes, to provide the services
2424 described by Section 50.0003 under the program. The commission may
2525 contract with the service providers to provide the services in
2626 accordance with this chapter.
2727 Sec. 50.0003. SERVICES. (a) Using the statewide network of
2828 service providers established under Section 50.0002, the
2929 commission shall ensure that program services are available
3030 throughout this state.
3131 (b) Services provided under the program include:
3232 (1) counseling and mentoring;
3333 (2) care coordination for prenatal services,
3434 including connecting program participants to health programs;
3535 (3) educational materials and information about
3636 pregnancy and parenting;
3737 (4) referrals to governmental and social service
3838 programs, including child care, transportation, housing, and state
3939 and federal benefit programs;
4040 (5) classes on life skills, personal finance,
4141 parenthood, stress management, job training, job placement, and
4242 methods for obtaining high school equivalency certificates;
4343 (6) provision of supplies for infant care and
4444 pregnancy, including car seats, cribs, maternity clothes, infant
4545 diapers, and formula; and
4646 (7) support groups in maternity homes.
4747 (c) The commission or service providers may not provide
4848 family planning services under the program.
4949 Sec. 50.0004. ELIGIBILITY. The program is available to a
5050 resident of this state who is:
5151 (1) a pregnant woman;
5252 (2) the biological father of an unborn child;
5353 (3) the biological parent of a child who is 24 months
5454 of age or younger;
5555 (4) an adoptive parent of a child who is 24 months of
5656 age or younger;
5757 (5) a prospective adoptive parent of an unborn child;
5858 (6) a former program participant who has experienced
5959 the loss of a child; and
6060 (7) a parent or legal guardian of a pregnant minor who
6161 is a program client.
6262 Sec. 50.0005. PROVISION OF SERVICES. The commission and
6363 service providers shall provide services under the program based on
6464 the needs of the program participants.
6565 Sec. 50.0006. FUNDING. (a) The commission shall, to the
6666 greatest extent possible, seek federal, governmental, and private
6767 funding to supplement and match funding provided to the program.
6868 (b) The commission or a service provider may not:
6969 (1) use funding provided to the program to perform,
7070 induce, assist, or refer an abortion; or
7171 (2) grant program funds to an abortion provider or an
7272 affiliate of an abortion provider.
7373 SECTION 2. This Act takes effect immediately if it receives
7474 a vote of two-thirds of all the members elected to each house, as
7575 provided by Section 39, Article III, Texas Constitution. If this
7676 Act does not receive the vote necessary for immediate effect, this
7777 Act takes effect September 1, 2019.
