55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of epinephrine auto-injectors in primary and
88 secondary schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.208(c), Education Code, is amended to
1111 read as follows:
1212 (c) The executive commissioner of the Health and Human
1313 Services Commission, [in consultation with the commissioner of
1414 education, and] with advice from the advisory committee, shall
1515 adopt rules regarding the maintenance, administration, and
1616 disposal of an epinephrine auto-injector at a school campus subject
1717 to a policy adopted under Subsection (a). The rules must
1818 establish:
1919 (1) the number of epinephrine auto-injectors
2020 available at each campus;
2121 (2) the process for each school district,
2222 open-enrollment charter school, and private school to check the
2323 inventory of epinephrine auto-injectors at regular intervals for
2424 expiration and replacement; and
2525 (3) the amount of training required for school
2626 personnel and school volunteers to administer an epinephrine
2727 auto-injector.
2828 SECTION 2. Section 38.209, Education Code, is amended to
2929 read as follows:
3030 Sec. 38.209. REPORT ON ADMINISTERING EPINEPHRINE
3131 AUTO-INJECTOR. (a) Not later than the 10th business day after the
3232 date a school personnel member or school volunteer administers an
3333 epinephrine auto-injector in accordance with a policy adopted under
3434 Section 38.208(a), the school shall report the information required
3535 under Subsection (b) to:
3636 (1) the school district, the charter holder if the
3737 school is an open-enrollment charter school, or the governing body
3838 of the school if the school is a private school;
3939 (2) the physician or other person who prescribed the
4040 epinephrine auto-injector; and
4141 (3) [the commissioner of education; and
4242 [(4)] the commissioner of state health services.
4343 (b) The report required under this section must include the
4444 following information:
4545 (1) the age of the person who received the
4646 administration of the epinephrine auto-injector;
4747 (2) whether the person who received the administration
4848 of the epinephrine auto-injector was a student, a school personnel
4949 member or school volunteer, or a visitor;
5050 (3) the physical location where the epinephrine
5151 auto-injector was administered;
5252 (4) the number of doses of epinephrine auto-injector
5353 administered;
5454 (5) the title of the person who administered the
5555 epinephrine auto-injector; and
5656 (6) any other information required by the commissioner
5757 of state health services [education].
5858 SECTION 3. Section 38.214, Education Code, is amended to
5959 read as follows:
6060 Sec. 38.214. RULES. The [Except as otherwise provided by
6161 this subchapter, the commissioner of education and the] executive
6262 commissioner of the Health and Human Services Commission shall
6363 [jointly] adopt rules necessary to implement this subchapter.
6464 SECTION 4. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2019.
