7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Sections 38.0025(a) and (c), Education Code, are |
---|
9 | 15 | | amended to read as follows: |
---|
10 | 16 | | (a) The Department of State Health Services [agency] shall |
---|
11 | 17 | | prescribe procedures by which each school district shall provide |
---|
12 | 18 | | information relating to bacterial meningitis to its students and |
---|
13 | 19 | | their parents each school year. The procedures must ensure that the |
---|
14 | 20 | | information is reasonably likely to come to the attention of the |
---|
15 | 21 | | parents of each student. The department [agency] shall prescribe |
---|
16 | 22 | | the form and content of the information. The information must |
---|
17 | 23 | | cover: |
---|
18 | 24 | | (1) the symptoms of the disease, how it may be |
---|
19 | 25 | | diagnosed, and its possible consequences if untreated; |
---|
20 | 26 | | (2) how the disease is transmitted, how it may be |
---|
21 | 27 | | prevented, and the relative risk of contracting the disease for |
---|
22 | 28 | | primary and secondary school students; |
---|
23 | 29 | | (3) the availability and effectiveness of vaccination |
---|
24 | 30 | | against and treatment for the disease, and a brief description of |
---|
25 | 31 | | the risks and possible side effects of vaccination; and |
---|
26 | 32 | | (4) sources of additional information regarding the |
---|
27 | 33 | | disease, including any appropriate office of the school district |
---|
28 | 34 | | and the appropriate office of the department [Texas Department of |
---|
29 | 35 | | Health]. |
---|
30 | 36 | | (c) A school district, with the written consent of the |
---|
31 | 37 | | Department of State Health Services [agency], may provide the |
---|
32 | 38 | | information required by this section to its students and their |
---|
33 | 39 | | parents by a method different from the method prescribed by the |
---|
34 | 40 | | department [agency] under Subsection (a) if the department [agency] |
---|
35 | 41 | | determines that method would be effective in bringing the |
---|
36 | 42 | | information to the attention of the parents of each student. |
---|
37 | 43 | | SECTION 2. Section 38.0025(b), Education Code, is repealed. |
---|
38 | 44 | | SECTION 3. This Act applies beginning with the 2019-2020 |
---|
39 | 45 | | school year. |
---|
40 | 46 | | SECTION 4. As soon as practicable after the effective date |
---|
41 | 47 | | of this Act, the Department of State Health Services shall develop |
---|
42 | 48 | | the procedures under Section 38.0025, Education Code, as amended by |
---|
43 | 49 | | this Act. |
---|
44 | 50 | | SECTION 5. This Act takes effect immediately if it receives |
---|
45 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
47 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
48 | 54 | | Act takes effect September 1, 2019. |
