9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to dissemination of bacterial meningitis information by
612 school districts.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Sections 38.0025(a) and (c), Education Code, are
915 amended to read as follows:
1016 (a) The Department of State Health Services [agency] shall
1117 prescribe procedures by which each school district shall provide
1218 information relating to bacterial meningitis to its students and
1319 their parents each school year. The procedures must ensure that the
1420 information is reasonably likely to come to the attention of the
1521 parents of each student. The department [agency] shall prescribe
1622 the form and content of the information. The information must
1723 cover:
1824 (1) the symptoms of the disease, how it may be
1925 diagnosed, and its possible consequences if untreated;
2026 (2) how the disease is transmitted, how it may be
2127 prevented, and the relative risk of contracting the disease for
2228 primary and secondary school students;
2329 (3) the availability and effectiveness of vaccination
2430 against and treatment for the disease, and a brief description of
2531 the risks and possible side effects of vaccination; and
2632 (4) sources of additional information regarding the
2733 disease, including any appropriate office of the school district
2834 and the appropriate office of the department [Texas Department of
2935 Health].
3036 (c) A school district, with the written consent of the
3137 Department of State Health Services [agency], may provide the
3238 information required by this section to its students and their
3339 parents by a method different from the method prescribed by the
3440 department [agency] under Subsection (a) if the department [agency]
3541 determines that method would be effective in bringing the
3642 information to the attention of the parents of each student.
3743 SECTION 2. Section 38.0025(b), Education Code, is repealed.
3844 SECTION 3. This Act applies beginning with the 2019-2020
3945 school year.
4046 SECTION 4. As soon as practicable after the effective date
4147 of this Act, the Department of State Health Services shall develop
4248 the procedures under Section 38.0025, Education Code, as amended by
4349 this Act.
4450 SECTION 5. This Act takes effect immediately if it receives
4551 a vote of two-thirds of all the members elected to each house, as
4652 provided by Section 39, Article III, Texas Constitution. If this
4753 Act does not receive the vote necessary for immediate effect, this
4854 Act takes effect September 1, 2019.
