55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a school district's plan for parental involvement
88 concerning mental health and substance use issues and suicide
99 prevention.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 28.004(c), Education Code, is amended to
1212 read as follows:
1313 (c) The local school health advisory council's duties
1414 include recommending:
1515 (1) the number of hours of instruction to be provided
1616 in health education;
1717 (2) policies, procedures, strategies, and curriculum
1818 appropriate for specific grade levels designed to prevent obesity,
1919 cardiovascular disease, Type 2 diabetes, and mental health
2020 concerns, including suicide, through coordination of:
2121 (A) health education;
2222 (B) physical education and physical activity;
2323 (C) nutrition services;
2424 (D) parental involvement;
2525 (E) instruction to prevent the use of
2626 e-cigarettes, as defined by Section 161.081, Health and Safety
2727 Code, and tobacco;
2828 (F) school health services;
2929 (G) counseling and guidance services;
3030 (H) a safe and healthy school environment; and
3131 (I) school employee wellness;
3232 (3) appropriate grade levels and methods of
3333 instruction for human sexuality instruction;
3434 (4) strategies for integrating the curriculum
3535 components specified by Subdivision (2) with the following elements
3636 in a coordinated school health program for the district:
3737 (A) school health services;
3838 (B) counseling and guidance services;
3939 (C) a safe and healthy school environment; and
4040 (D) school employee wellness; [and]
4141 (5) if feasible, joint use agreements or strategies
4242 for collaboration between the school district and community
4343 organizations or agencies; and
4444 (6) strategies to increase parental awareness
4545 regarding:
4646 (A) risky behaviors and early warning signs of
4747 suicide risks and behavioral health concerns, including mental
4848 health disorders and substance use disorders; and
4949 (B) available community programs and services
5050 that address risky behaviors, suicide risks, and behavioral health
5151 concerns.
5252 SECTION 2. Section 161.325(d), Health and Safety Code, is
5353 amended to read as follows:
5454 (d) A school district may develop practices and procedures
5555 concerning each area listed in Subsection (a-1), including mental
5656 health promotion and intervention, substance abuse prevention and
5757 intervention, and suicide prevention, that:
5858 (1) include a procedure for providing educational
5959 material to all parents and families in the district that contains
6060 information on identifying risk factors, accessing resources for
6161 treatment or support provided on and off campus, and accessing
6262 available student accommodations provided on campus;
6363 (2) include a procedure for providing notice of a
6464 recommendation for early mental health or substance abuse
6565 intervention regarding a student to a parent or guardian of the
6666 student within a reasonable amount of time after the identification
6767 of early warning signs as described by Subsection (b)(2);
6868 (3) [(2)] include a procedure for providing notice of
6969 a student identified as at risk of committing suicide to a parent or
7070 guardian of the student within a reasonable amount of time after the
7171 identification of early warning signs as described by Subsection
7272 (b)(2);
7373 (4) [(3)] establish that the district may develop a
7474 reporting mechanism and may designate at least one person to act as
7575 a liaison officer in the district for the purposes of identifying
7676 students in need of early mental health or substance abuse
7777 intervention or suicide prevention; and
7878 (5) [(4)] set out available counseling alternatives
7979 for a parent or guardian to consider when their child is identified
8080 as possibly being in need of early mental health or substance abuse
8181 intervention or suicide prevention.
8282 SECTION 3. Subchapter O-1, Chapter 161, Health and Safety
8383 Code, is amended by adding Section 161.3255 to read as follows:
8484 Sec. 161.3255. PARENT EDUCATION ON BEHAVIORAL HEALTH
8585 ISSUES. (a) In this section, "parent" includes a guardian or other
8686 person standing in parental relation.
8787 (b) At each campus in a school district in which at least 70
8888 percent of the students in average daily attendance are
8989 educationally disadvantaged, homeless, as defined by 42 U.S.C.
9090 Section 11302, or in the conservatorship of the Department of
9191 Family and Protective Services, the district shall develop and
9292 implement a plan to increase parent and student knowledge and
9393 understanding of behavioral health disorders and treatment
9494 options. The plan must include strategies to educate and assist
9595 students and parents on:
9696 (1) identifying mental health disorders, substance
9797 use disorders, suicidal ideation, and issues related to trauma in
9898 children and youth;
9999 (2) accessing resources for treatment or support
100100 provided on and off campus; and
101101 (3) accessing available accommodations provided on
102102 campus for student success.
103103 (c) A school district may use internal or external resources
104104 to implement the strategies included in the plan required under
105105 Subsection (b), including:
106106 (1) developing and integrating behavioral health
107107 education as part of the health curriculum;
108108 (2) collaborating with behavioral health providers
109109 for treatment referrals and treatment services provided on campus;
110110 (3) establishing partnerships with community-based
111111 organizations to provide relevant education and support;
112112 (4) designating a behavioral-health parent-liaison at
113113 each campus of the district; and
114114 (5) exploring other promising practices in the areas
115115 of identifying and treating mental health disorders, substance use
116116 disorders, suicidal ideation, and issues related to trauma in
117117 children and youth.
118118 SECTION 4. This Act applies beginning with the 2019-2020
119119 school year.
120120 SECTION 5. This Act takes effect September 1, 2019.
