| 7 | 7 | | relating to the election of trustees of certain school districts. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 11.052, Education Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (b-3) and amending Subsection (d) to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | (b-3) Subsection (c) does not apply in the case of an order |
|---|
| 13 | 13 | | adopted under this subsection. The board of trustees of an |
|---|
| 14 | 14 | | independent school district located wholly or partly in a county |
|---|
| 15 | 15 | | with a population of more than two million but less than three |
|---|
| 16 | 16 | | million shall order that trustees of the district are to be elected |
|---|
| 17 | 17 | | from single-member trustee districts if the district, in October |
|---|
| 18 | 18 | | 2017, had: |
|---|
| 19 | 19 | | (1) a student enrollment of more than 50,000; |
|---|
| 20 | 20 | | (2) a student enrollment of more than 35,000 but less |
|---|
| 21 | 21 | | than 40,000; or |
|---|
| 22 | 22 | | (3) a student enrollment of more than 24,000 but less |
|---|
| 23 | 23 | | than 28,000. |
|---|
| 24 | 24 | | (d) An order of the board adopted under Subsection (a), [or] |
|---|
| 25 | 25 | | (b), or (b-3) must be entered not later than the 120th day before |
|---|
| 26 | 26 | | the date of the first election at which all or some of the trustees |
|---|
| 27 | 27 | | are elected from single-member trustee districts authorized by the |
|---|
| 28 | 28 | | order. |
|---|
| 29 | 29 | | SECTION 2. The board of trustees of a school district to |
|---|
| 30 | 30 | | which Section 11.052(b-3), Education Code, as added by this Act, |
|---|
| 31 | 31 | | applies shall adopt an order as required by that section not later |
|---|
| 32 | 32 | | than December 31, 2019. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2019. |
