8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 28.01(c), Alcoholic Beverage Code, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | (c) The holder of a mixed beverage permit may also: | |
12 | 12 | (1) purchase wine, beer, ale, and malt liquor | |
13 | 13 | containing alcohol of not more than 21 percent by volume in | |
14 | 14 | containers of any legal size from any permittee or licensee | |
15 | 15 | authorized to sell those beverages for resale; and | |
16 | 16 | (2) sell the wine, beer, ale, and malt liquor for | |
17 | 17 | consumption on the licensed premises. | |
18 | 18 | (3) permit the consumption of lawfully acquired wine | |
19 | 19 | by the ultimate consumer on the licensed premises. The permit | |
20 | 20 | holder may charge a corkage fee to such consumer for the wine so | |
21 | 21 | consumed; however, the licensee shall not charge any other related | |
22 | 22 | fee to such customer. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2019. |
