6	6	AN ACT
7	7	relating to use of the electronic funds transfer system operated by
8	8	the comptroller.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 403.016, Government Code, is amended by
11	11	amending Subsections (b), (c), and (f) and adding Subsections (f-1)
12	12	and (f-2) to read as follows:
13	13	(b) The comptroller shall use the electronic funds transfer
14	14	system to pay an employee's net state salary and travel expense
15	15	reimbursements [unless:
16	16	[(1) the employee does not hold a classified position
17	17	under the state's position classification plan and the employee's
18	18	gross state salary is less than the gross state salary for a
19	19	position classified to group 8, step 1, of the state position
20	20	classification plan; or
21	21	[(2) the employee holds a classified position under the
22	22	state's position classification plan that is classified below group
23	23	8].
24	24	(c) The comptroller shall use the electronic funds transfer
25	25	system to make:
26	26	(1) payments of more than $100 to annuitants by the
27	27	Employees Retirement System of Texas, [or] the Teacher Retirement
28	28	System of Texas, or the Texas Emergency Services Retirement System
29	29	under each [either] system's administrative jurisdiction;
30	30	(2) recurring payments to municipalities, counties,
31	31	political subdivisions, special districts, and other governmental
32	32	entities of this state; and
33	33	(3) payments to vendors who choose to receive payment
34	34	through the electronic funds transfer system rather than by
35	35	warrant.
36	36	(f) [(1)] Except as provided by Subsection (f-1)
37	37	[Subdivisions (2) and (4)] and subject to any limitation in rules
38	38	adopted by the comptroller, an automated clearinghouse, or the
39	39	federal government, the comptroller may use the electronic funds
40	40	transfer system to deposit payments only to one or more accounts of
41	41	a payee at one or more financial institutions, including credit
42	42	unions.
43	43	(f-1) [(2)] The comptroller may also use the electronic
44	44	funds transfer system to deposit the amount [a portion] of an
45	45	employee's payroll deduction made as authorized by law [gross pay
46	46	into the employee's account at a credit union as prescribed by
47	47	Subchapter G, Chapter 659].
48	48	(f-2) [(3)] A single electronic funds transfer may contain
49	49	payments to multiple payees. Individual transfers or warrants are
50	50	not required for each payee.
51	51	[(4) The comptroller may also use the electronic funds
52	52	transfer system to deposit a portion of an employee's gross pay into
53	53	an account of an eligible state employee organization for a
54	54	membership as prescribed by Subchapter G, Chapter 659.]
55	55	SECTION 2. This Act takes effect immediately if it receives
56	56	a vote of two-thirds of all the members elected to each house, as
57	57	provided by Section 39, Article III, Texas Constitution. If this
58	58	Act does not receive the vote necessary for immediate effect, this
59	59	Act takes effect September 1, 2019.
