| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 62.051, Labor Code, is amended to read as |
|---|
| 9 | 9 | | follows: |
|---|
| 10 | 10 | | Sec. 62.051. MINIMUM WAGE. (a) Except as provided by |
|---|
| 11 | 11 | | Section 62.057, an employer shall pay to each employee not less |
|---|
| 12 | 12 | | than the greater of: |
|---|
| 13 | 13 | | (1) $15 an hour; or |
|---|
| 14 | 14 | | (2) the federal minimum wage under Section 6, Fair |
|---|
| 15 | 15 | | Labor Standards Act of 1938 (29 U.S.C. Section 206). |
|---|
| 16 | 16 | | (b) This subsection applies to wages paid by an employer for |
|---|
| 17 | 17 | | the 2020, 2021, 2022, 2023, and 2024 calendar years. Subsection (a) |
|---|
| 18 | 18 | | does not apply in a year to which this subsection applies. Except |
|---|
| 19 | 19 | | as provided by Section 62.057: |
|---|
| 20 | 20 | | (1) for the 2020 calendar year, an employer shall pay |
|---|
| 21 | 21 | | to each employee not less than the greater of: |
|---|
| 22 | 22 | | (A) $9.25 an hour; or |
|---|
| 23 | 23 | | (B) the federal minimum wage under Section 6, |
|---|
| 24 | 24 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and |
|---|
| 25 | 25 | | (2) for the 2021 calendar year, an employer shall pay |
|---|
| 26 | 26 | | to each employee not less than the greater of: |
|---|
| 27 | 27 | | (A) $10 an hour; or |
|---|
| 28 | 28 | | (B) the federal minimum wage under Section 6, |
|---|
| 29 | 29 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and |
|---|
| 30 | 30 | | (3) for the 2022 calendar year, an employer shall pay |
|---|
| 31 | 31 | | to each employee not less than the greater of: |
|---|
| 32 | 32 | | (A) $12 an hour; or |
|---|
| 33 | 33 | | (B) the federal minimum wage under Section 6, |
|---|
| 34 | 34 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and |
|---|
| 35 | 35 | | (4) for the 2023 calendar year, an employer shall pay |
|---|
| 36 | 36 | | to each employee not less than the greater of: |
|---|
| 37 | 37 | | (A) $13 an hour; or |
|---|
| 38 | 38 | | (B) the federal minimum wage under Section 6, |
|---|
| 39 | 39 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and |
|---|
| 40 | 40 | | (5) for the 2024 calendar year, an employer shall pay |
|---|
| 41 | 41 | | to each employee not less than the greater of: |
|---|
| 42 | 42 | | (A) $14 an hour; or |
|---|
| 43 | 43 | | (B) the federal minimum wage under Section 6, |
|---|
| 44 | 44 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206). |
|---|
| 45 | 45 | | (c) Subsection (b) and this subsection expire January 1, |
|---|
| 46 | 46 | | 2025. |
|---|
| 47 | 47 | | SECTION 2. Section 62.151, Labor Code, is repealed. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect January 1, 2020. |
