118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 361.121(a)(2), Health and Safety Code,
1310 is amended to read as follows:
1411 (2) "Land application unit" means an area where wastes
1512 are applied onto or incorporated into the soil surface for
1613 agricultural purposes or for treatment and disposal. The term does
1714 not include manure spreading operations or placement of waste on a
1815 liner registered or permitted by the commission.
1916 SECTION 2. Subchapter C, Chapter 361, Health and Safety
2017 Code, is amended by adding Section 361.1215 to read as follows:
21- Sec. 361.1215. LAND APPLICATION OF GRIT TRAP WASTE AND
22- GREASE TRAP WASTE PROHIBITED. (a) In this section:
18+ Sec. 361.1215. LAND APPLICATION OF GRIT AND GREASE TRAP
19+ WASTE PROHIBITED. (a) In this section:
2320 (1) "Grease trap waste" means a material collected in
2421 and from a grease interceptor in the sanitary sewer line of a
2522 commercial, institutional, or industrial food service or
2623 processing facility. The term includes the solids resulting from a
2724 dewatering process.
2825 (2) "Grit trap" means a unit or chamber that:
2926 (A) allows the sedimentation of solids from an
3027 influent liquid stream by reducing the flow velocity of the stream;
3128 (B) has an inlet and outlet that are both located
3229 at the same vertical level at or near the top of the unit or chamber;
3330 (C) has an outlet that is connected to a sanitary
3431 sewer system; and
3532 (D) is not designed to separate oil and water.
3633 (3) "Grit trap waste" means the waste collected in a
3734 grit trap. The term includes waste from an interceptor placed in a
3835 drain at maintenance and repair shops, automobile service stations,
3936 car washes, laundries, and other similar facilities.
4037 (b) The commission may not issue a permit, registration, or
4138 other authorization for land application of grease trap waste or
4239 grit trap waste.
4340 (c) This section does not apply to:
4441 (1) the disposal of grease trap waste or grit trap
4542 waste at a municipal solid waste Type I landfill permitted by the
4643 commission;
4744 (2) the processing of grease trap waste or grit trap
4845 waste at a municipal solid waste Type V compost facility permitted
4946 or registered by the commission; or
5047 (3) land application of Grade 1 or Grade 2 compost
5148 generated at a Type V compost facility permitted to compost grease
5249 trap waste by the commission.
5350 SECTION 3. A permit, registration, or other authorization
5451 issued by the Texas Commission on Environmental Quality that allows
5552 the land application of grease trap waste or grit trap waste expires
5653 on the effective date of this Act. The remainder of a permit,
5754 registration, or other authorization that contains items in
5855 addition to an authorization allowing the land application of
5956 grease trap waste or grit trap waste remains in effect to the extent
6057 that it does not authorize the land application of grease trap waste
6158 or grit trap waste.
6259 SECTION 4. This Act takes effect immediately if it receives
6360 a vote of two-thirds of all the members elected to each house, as
6461 provided by Section 39, Article III, Texas Constitution. If this
6562 Act does not receive the vote necessary for immediate effect, this
66- Act takes effect September 1, 2019.
63+ Act takes effect September 1, 2017.
