4	10		AN ACT
5	11		relating to the authority of rural hospitals to establish a health
6	12		care collaborative.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 848.001, Insurance Code, is amended by
9	15		amending Subdivision (2) and adding Subdivision (10) to read as
10	16		follows:
11	17		(2) "Health care collaborative" means an entity:
12	18		(A) that undertakes to arrange for medical and
13	19		health care services for insurers, health maintenance
14	20		organizations, and other payors in exchange for payments in cash or
15	21		in kind;
16	22		(B) that accepts and distributes payments for
17	23		medical and health care services;
18	24		(C) that consists of:
19	25		(i) physicians;
20	26		(ii) rural hospitals;
21	27		(iii) physicians and other health care
22	28		providers;
23	29		(iv) [(iii)] physicians and insurers or
24	30		health maintenance organizations; or
25	31		(v) [(iv)] physicians, other health care
26	32		providers, and insurers or health maintenance organizations; and
27	33		(D) that is certified by the commissioner under
28	34		this chapter to lawfully accept and distribute payments to
29	35		physicians and other health care providers using the reimbursement
30	36		methodologies authorized by this chapter.
31	37		(10) "Rural hospital" means a licensed hospital with
32	38		75 beds or fewer that:
33	39		(A) is located in a county with a population of
34	40		50,000 or less; or
35	41		(B) has been designated by the Centers for
36	42		Medicare and Medicaid Services as a critical access hospital, rural
37	43		referral center, or sole community hospital.
38	44		SECTION 2. Section 848.052, Insurance Code, is amended by
39	45		adding Subsection (c-1) to read as follows:
40	46		(c-1) If the participants in a health care collaborative are
41	47		all rural hospitals, each member of the board of directors must be a
42	48		representative of a participant.
43	49		SECTION 3. This Act takes effect immediately if it receives
44	50		a vote of two-thirds of all the members elected to each house, as
45	51		provided by Section 39, Article III, Texas Constitution. If this
46	52		Act does not receive the vote necessary for immediate effect, this
47	53		Act takes effect September 1, 2019.
