66 AN ACT
77 relating to the certification of constables and deputy constables
88 to enforce commercial motor vehicle safety standards.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 644.101(a) and (c), Transportation
1111 Code, are amended to read as follows:
1212 (a) The department shall establish procedures, including
1313 training, for the certification of municipal police officers,
1414 sheriffs, [and] deputy sheriffs, constables, and deputy constables
1515 to enforce this chapter.
1616 (c) A sheriff, [or a] deputy sheriff, constable, or deputy
1717 constable of a county bordering the United Mexican States or of a
1818 county with a population of 700,000 or more is eligible to apply for
1919 certification under this section.
2020 SECTION 2. Section 644.103(b), Transportation Code, is
2121 amended to read as follows:
2222 (b) A municipal police officer who is certified under
2323 Section 644.101 may stop, enter, or detain on a highway or at a port
2424 of entry within the territory of the municipality a motor vehicle
2525 that is subject to this chapter. A sheriff, [or] deputy sheriff,
2626 constable, or deputy constable who is certified under Section
2727 644.101 may stop, enter, or detain on a highway or at a port of entry
2828 within the territory of the county a motor vehicle that is subject
2929 to this chapter.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2019.
