4	10		AN ACT
5	11		relating to acceptable uses of the instructional materials and
6	12		technology fund and the instructional materials and technology
7	13		allotment.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. Section 31.021(c), Education Code, as amended by
10	16		Chapters 581 (S.B. 810) and 705 (H.B. 3526), Acts of the 85th
11	17		Legislature, Regular Session, 2017, is reenacted and amended to
12	18		read as follows:
13	19		(c) Money in the state instructional materials and
14	20		technology fund shall be used to:
15	21		(1) fund the instructional materials and technology
16	22		allotment, as provided by Section 31.0211;
17	23		(2) purchase special instructional materials for the
18	24		education of blind and visually impaired students in public
19	25		schools;
20	26		(3) pay the expenses associated with the instructional
21	27		materials adoption and review process under this chapter;
22	28		(4) pay the expenses associated with the purchase or
23	29		licensing of open education resource instructional material;
24	30		(5) pay the expenses associated with the purchase of
25	31		instructional material, including [intrastate] freight and
26	32		shipping and the insurance expenses associated with [intrastate]
27	33		freight and shipping;
28	34		(6) fund the technology lending grant program
29	35		established under Section 32.301;
30	36		(7) provide funding to the Texas School for the Blind
31	37		and Visually Impaired, the Texas School for the Deaf, and the Texas
32	38		Juvenile Justice Department; and
33	39		(8) pay the expenses associated with the instructional
34	40		materials web portal developed under Section 31.081.
35	41		SECTION 2. Section 31.0211(c), Education Code, is amended
36	42		to read as follows:
37	43		(c) Subject to Subsection (d), funds allotted under this
38	44		section may be used to:
39	45		(1) purchase:
40	46		(A) materials on the list adopted by the
41	47		commissioner, as provided by Section 31.0231;
42	48		(B) instructional materials, regardless of
43	49		whether the instructional materials are on the list adopted under
44	50		Section 31.024;
45	51		(C) consumable instructional materials,
46	52		including workbooks;
47	53		(D) instructional materials for use in bilingual
48	54		education classes, as provided by Section 31.029;
49	55		(E) instructional materials for use in college
50	56		preparatory courses under Section 28.014, as provided by Section
51	57		31.031;
52	58		(F) supplemental instructional materials, as
53	59		provided by Section 31.035;
54	60		(G) state-developed open education resource
55	61		instructional materials, as provided by Subchapter B-1;
56	62		(H) instructional materials and technological
57	63		equipment under any continuing contracts of the district in effect
58	64		on September 1, 2011; [and]
59	65		(I) technological equipment necessary to support
60	66		the use of materials included on the list adopted by the
61	67		commissioner under Section 31.0231 or any instructional materials
62	68		purchased with an allotment under this section; and
63	69		(J) inventory software or systems for storing,
64	70		managing, and accessing instructional materials and analyzing the
65	71		usage and effectiveness of the instructional materials; and
66	72		(2) pay:
67	73		(A) for training educational personnel directly
68	74		involved in student learning in the appropriate use of
69	75		instructional materials and for providing for access to
70	76		technological equipment for instructional use; and
71	77		(B) the salary and other expenses of an employee
72	78		who provides technical support for the use of technological
73	79		equipment directly involved in student learning.
74	80		SECTION 3. This Act takes effect September 1, 2019.
