66 AN ACT
77 relating to funding for open-enrollment charter schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 12.106(a-1) and (a-2), Education Code,
1010 are amended to read as follows:
1111 (a-1) In determining funding for an open-enrollment charter
1212 school under Subsection (a):
1313 (1) adjustments under Sections 42.102, 42.104, and
1414 42.105 are based on the lesser of:
1515 (A) the average adjustment for the state; or
1616 (B) the adjustment for the school district within
1717 whose boundaries the charter holder's campus with the greatest
1818 enrollment is located; and
1919 (2) the adjustment under Section 42.103 is based on
2020 the lesser of:
2121 (A) the average adjustment for the state that
2222 would have been provided under that section as it existed on January
2323 1, 2018; or
2424 (B) the adjustment for the school district within
2525 whose boundaries the charter holder's campus with the greatest
2626 enrollment is located.
2727 (a-2) In addition to the funding provided by Subsection (a),
2828 a charter holder is entitled to receive for the open-enrollment
2929 charter school enrichment funding under Section 42.302 based on the
3030 lesser of:
3131 (1) the state average tax effort; or
3232 (2) the tax effort of the school district within whose
3333 boundaries the charter holder's campus with the greatest enrollment
3434 is located.
3535 SECTION 2. This Act takes effect September 1, 2019.
