| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 12.106(a-1) and (a-2), Education Code, |
|---|
| 10 | 10 | | are amended to read as follows: |
|---|
| 11 | 11 | | (a-1) In determining funding for an open-enrollment charter |
|---|
| 12 | 12 | | school under Subsection (a): |
|---|
| 13 | 13 | | (1) adjustments under Sections 42.102, 42.104, and |
|---|
| 14 | 14 | | 42.105 are based on the lesser of: |
|---|
| 15 | 15 | | (A) the average adjustment for the state; or |
|---|
| 16 | 16 | | (B) the adjustment for the school district within |
|---|
| 17 | 17 | | whose boundaries the charter holder's campus with the greatest |
|---|
| 18 | 18 | | enrollment is located; and |
|---|
| 19 | 19 | | (2) the adjustment under Section 42.103 is based on |
|---|
| 20 | 20 | | the lesser of: |
|---|
| 21 | 21 | | (A) the average adjustment for the state that |
|---|
| 22 | 22 | | would have been provided under that section as it existed on January |
|---|
| 23 | 23 | | 1, 2018; or |
|---|
| 24 | 24 | | (B) the adjustment for the school district within |
|---|
| 25 | 25 | | whose boundaries the charter holder's campus with the greatest |
|---|
| 26 | 26 | | enrollment is located. |

| 27 | 27 | | (a-2) In addition to the funding provided by Subsection (a), |
|---|
| 28 | 28 | | a charter holder is entitled to receive for the open-enrollment |
|---|
| 29 | 29 | | charter school enrichment funding under Section 42.302 based on the |
|---|
| 30 | 30 | | lesser of: |
|---|
| 31 | 31 | | (1) the state average tax effort; or |
|---|
| 32 | 32 | | (2) the tax effort of the school district within whose |
|---|
| 33 | 33 | | boundaries the charter holder's campus with the greatest enrollment |
|---|
| 34 | 34 | | is located. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2019. |
