9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article 42.037(m), Code of Criminal Procedure, | |
11 | 11 | is amended to read as follows: | |
12 | 12 | (m) An order of restitution may be enforced by the state or a | |
13 | 13 | victim named in the order to receive the restitution in the same | |
14 | 14 | manner as a judgment in a civil action. After the court certifies | |
15 | 15 | the order, the state or victim may file the order with a trial court | |
16 | 16 | with civil jurisdiction, and the civil court shall immediately | |
17 | 17 | enter a civil judgment for the amount of the order that is effective | |
18 | 18 | the 30th day after the date the order is entered. The state or | |
19 | 19 | victim is not required to serve notice on the defendant to obtain | |
20 | 20 | the civil judgment. | |
21 | 21 | SECTION 2. Article 42.037, Code of Criminal Procedure, as | |
22 | 22 | amended by this Act, applies only to an order of restitution not | |
23 | 23 | collected on or after the effective date of this Act. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2019. |
