55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to civil enforcement of an order of restitution for a
88 criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 42.037(m), Code of Criminal Procedure,
1111 is amended to read as follows:
1212 (m) An order of restitution may be enforced by the state or a
1313 victim named in the order to receive the restitution in the same
1414 manner as a judgment in a civil action. After the court certifies
1515 the order, the state or victim may file the order with a trial court
1616 with civil jurisdiction, and the civil court shall immediately
1717 enter a civil judgment for the amount of the order that is effective
1818 the 30th day after the date the order is entered. The state or
1919 victim is not required to serve notice on the defendant to obtain
2020 the civil judgment.
2121 SECTION 2. Article 42.037, Code of Criminal Procedure, as
2222 amended by this Act, applies only to an order of restitution not
2323 collected on or after the effective date of this Act.
2424 SECTION 3. This Act takes effect September 1, 2019.
