7 | 7 | | relating to the creation of a study of TRS-ActiveCare administered |
---|
8 | 8 | | by the Teacher Retirement System of Texas. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. COMMITTEE. (a) A committee is created to study |
---|
11 | 11 | | and review TRS-ActiveCare, administered under Chapter 1579, |
---|
12 | 12 | | Insurance Code, and propose reforms to address issues described by |
---|
13 | 13 | | Section 2 of this Act. |
---|
14 | 14 | | (b) The committee is composed of the following members: |
---|
15 | 15 | | (1) two persons appointed by the governor; |
---|
16 | 16 | | (2) two persons appointed by the lieutenant governor; |
---|
17 | 17 | | (3) two persons appointed by the speaker of the house |
---|
18 | 18 | | of representatives; and |
---|
19 | 19 | | (4) two persons employed by the Teacher Retirement |
---|
20 | 20 | | System of Texas and appointed by the board of trustees of the |
---|
21 | 21 | | system. |
---|
22 | 22 | | SECTION 2. STUDY REGARDING CERTAIN HEALTH BENEFIT PLANS. |
---|
23 | 23 | | The committee created by Section 1 of this Act shall study |
---|
24 | 24 | | TRS-ActiveCare to examine and assess the following issues: |
---|
25 | 25 | | (1) the financial soundness of the plans offered under |
---|
26 | 26 | | TRS-ActiveCare; |
---|
27 | 27 | | (2) the cost and affordability of plan coverage to |
---|
28 | 28 | | persons eligible for coverage under the plans; |
---|
29 | 29 | | (3) the sufficiency of access to physicians and health |
---|
30 | 30 | | care providers under the plans; and |
---|
31 | 31 | | (4) alternative mechanisms for offering health |
---|
32 | 32 | | benefit plan coverage to the affected employees and the affected |
---|
33 | 33 | | employees' dependents. |
---|
34 | 34 | | SECTION 3. COMMITTEE FINDINGS AND RECOMMENDATIONS. (a) |
---|
35 | 35 | | Not later than January 15, 2021, the committee appointed under this |
---|
36 | 36 | | Act shall report the committee's findings and recommendations to |
---|
37 | 37 | | the lieutenant governor, the speaker of the house of |
---|
38 | 38 | | representatives, and the governor. The committee shall include in |
---|
39 | 39 | | its recommendations specific statutory and regulatory changes that |
---|
40 | 40 | | appear beneficial from the results of the committee's study under |
---|
41 | 41 | | Section 2 of this Act. |
---|
42 | 42 | | (b) Not later than the 60th day after the effective date of |
---|
43 | 43 | | this Act, the governor, lieutenant governor, speaker of the house |
---|
44 | 44 | | of representatives, and board of trustees of the Teacher Retirement |
---|
45 | 45 | | System of Texas shall appoint the members of the committee created |
---|
46 | 46 | | under Section 1 of this Act in accordance with that section. |
---|
47 | 47 | | SECTION 4. ABOLITION OF COMMITTEE. The committee created |
---|
48 | 48 | | by this Act is abolished and this Act expires January 20, 2021. |
---|
49 | 49 | | SECTION 5. EFFECTIVE DATE. This Act takes effect |
---|
50 | 50 | | immediately if it receives a vote of two-thirds of all the members |
---|
51 | 51 | | elected to each house, as provided by Section 39, Article III, Texas |
---|
52 | 52 | | Constitution. If this Act does not receive the vote necessary for |
---|
53 | 53 | | immediate effect, this Act takes effect September 1, 2019. |
