55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to court costs imposed on conviction and deposited to the
88 courthouse security fund or the municipal court building security
99 fund; increasing fees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Articles 102.017(a) and (b), Code of Criminal
1212 Procedure, are amended to read as follows:
1313 (a) A defendant convicted of a felony offense in a district
1414 court shall pay a $10 [$5] security fee as a cost of court.
1515 (b) A defendant convicted of a misdemeanor offense in a
1616 county court, county court at law, or district court shall pay a $5
1717 [$3] security fee as a cost of court. A defendant convicted of a
1818 misdemeanor offense in a justice court shall pay a $5 [$4] security
1919 fee as a cost of court. The governing body of a municipality by
2020 ordinance may create a municipal court building security fund and
2121 may require a defendant convicted of a misdemeanor offense in a
2222 municipal court to pay a $5 [$3] security fee as a cost of court.
2323 SECTION 2. Section 102.041, Government Code, is amended to
2424 read as follows:
2525 Sec. 102.041. ADDITIONAL COURT COSTS ON CONVICTION IN
2626 DISTRICT COURT: CODE OF CRIMINAL PROCEDURE. The clerk of a
2727 district court shall collect fees and costs under the Code of
2828 Criminal Procedure on conviction of a defendant as follows:

140140 SECTION 7. The change in law made by this Act applies only
141141 to court costs imposed on conviction of an offense committed on or
142142 after January 1, 2020. For purposes of this section, an offense is
143143 committed before January 1, 2020, if any element of the offense
144144 occurs before that date. Court costs imposed on conviction of an
145145 offense committed before January 1, 2020, are governed by the law in
146146 effect immediately before the effective date of this Act, and the
147147 former law is continued in effect for that purpose.
148148 SECTION 8. This Act takes effect September 1, 2019.
