55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the designation of van-only parking spaces for use by
88 persons with disabilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 469.052, Government Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) The commission by rule shall require, for a building or
1313 facility that is required under 28 C.F.R. Part 36 to designate one
1414 or more van-accessible parking spaces, that at least one of those
1515 parking spaces be designated for use only by vans.
1616 SECTION 2. Section 681.006(a), Transportation Code, is
1717 amended to read as follows:
1818 (a) Subject to Section 681.009(e), a vehicle may be parked
1919 for an unlimited period:
2020 (1) in a parking space or area that is designated
2121 specifically for persons with physical disabilities, other than a
2222 space designated as van-only under Section 469.052(d), Government
2323 Code, if:
2424 (A) [(1)] the vehicle is being operated by or for
2525 the transportation of a person with a disability; and
2626 (B) [(2)] there are:
2727 (i) [(A)] displayed on the vehicle special
2828 license plates issued under Section 504.201; or
2929 (ii) [(B)] placed on the rearview mirror of
3030 the vehicle's front windshield a disabled parking placard; or
3131 (2) in a parking space designated as van-only under
3232 Section 469.052(d), Government Code, if:
3333 (A) the requirements of Subdivision (1) are met;
3434 and
3535 (B) the vehicle is a van.
3636 SECTION 3. Section 681.009(b), Transportation Code, is
3737 amended to read as follows:
3838 (b) A political subdivision must designate a parking space
3939 or area by conforming to the standards and specifications adopted
4040 by the Texas Commission of Licensing and Regulation under Section
4141 469.052, Government Code [5(i), Article 9102, Revised Statutes],
4242 relating to the identification and dimensions of parking spaces for
4343 persons with disabilities. A person who owns or controls private
4444 property used for parking may designate a parking space or area
4545 without conforming to those standards and specifications, unless
4646 required to conform by law.
4747 SECTION 4. This Act takes effect September 1, 2019.
