| 7 | 7 | | relating to the designation of van-only parking spaces for use by |

| 8 | 8 | | persons with disabilities. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 469.052, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (d) to read as follows: |
|---|
| 12 | 12 | | (d) The commission by rule shall require, for a building or |
|---|
| 13 | 13 | | facility that is required under 28 C.F.R. Part 36 to designate one |
|---|
| 14 | 14 | | or more van-accessible parking spaces, that at least one of those |
|---|
| 15 | 15 | | parking spaces be designated for use only by vans. |
|---|
| 16 | 16 | | SECTION 2. Section 681.006(a), Transportation Code, is |
|---|
| 17 | 17 | | amended to read as follows: |
|---|
| 18 | 18 | | (a) Subject to Section 681.009(e), a vehicle may be parked |
|---|
| 19 | 19 | | for an unlimited period: |
|---|
| 20 | 20 | | (1) in a parking space or area that is designated |
|---|
| 21 | 21 | | specifically for persons with physical disabilities, other than a |
|---|
| 22 | 22 | | space designated as van-only under Section 469.052(d), Government |
|---|
| 23 | 23 | | Code, if: |
|---|
| 24 | 24 | | (A) [(1)] the vehicle is being operated by or for |
|---|
| 25 | 25 | | the transportation of a person with a disability; and |
|---|
| 26 | 26 | | (B) [(2)] there are: |
|---|
| 27 | 27 | | (i) [(A)] displayed on the vehicle special |
|---|
| 28 | 28 | | license plates issued under Section 504.201; or |
|---|
| 29 | 29 | | (ii) [(B)] placed on the rearview mirror of |
|---|
| 30 | 30 | | the vehicle's front windshield a disabled parking placard; or |
|---|
| 31 | 31 | | (2) in a parking space designated as van-only under |
|---|
| 32 | 32 | | Section 469.052(d), Government Code, if: |
|---|
| 33 | 33 | | (A) the requirements of Subdivision (1) are met; |
|---|
| 34 | 34 | | and |
|---|
| 35 | 35 | | (B) the vehicle is a van. |
|---|
| 36 | 36 | | SECTION 3. Section 681.009(b), Transportation Code, is |
|---|
| 37 | 37 | | amended to read as follows: |
|---|
| 38 | 38 | | (b) A political subdivision must designate a parking space |
|---|
| 39 | 39 | | or area by conforming to the standards and specifications adopted |
|---|
| 40 | 40 | | by the Texas Commission of Licensing and Regulation under Section |
|---|
| 41 | 41 | | 469.052, Government Code [5(i), Article 9102, Revised Statutes], |
|---|
| 42 | 42 | | relating to the identification and dimensions of parking spaces for |
|---|
| 43 | 43 | | persons with disabilities. A person who owns or controls private |
|---|
| 44 | 44 | | property used for parking may designate a parking space or area |
|---|
| 45 | 45 | | without conforming to those standards and specifications, unless |
|---|
| 46 | 46 | | required to conform by law. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect September 1, 2019. |
